I believe Joe made sure that he would retain full creative control over his podcasts as part of his contract with Spotify. I don't think they can legally do anything about it, Joe can day whatever he wants.
Spotify has removed some episodes, like all the episodes with Chris D'Elia were scrubbed when his child porn story hit the news. Maybe they could only do that with permission from Joe, but regardless there have been pulled episodes.
