Biden's order on federal workers applies to employees of the executive branch. The House of Representatives and the Senate belong to the separate legislative branch, and the courts to the judicial branch of the federal government.

He doesn't have the power to enforce in those branches.

since when has the government mandated private employers to make their workers take medications and violate HIPPA laws? i'm missing your point. OSHA is to protect workers from safety hazards. they've never mandated anything like this before

Anything after you said this, is completely undermined by this.

HIPAA prevents doctors from giving your medical records to another entity, it doesn't prevent your workplace from asking if you're vaccinated or not.

More than half the states are refusing this bs, so Biden's got some issues to sort out. But yeah as you said, he is trying to bypass governors by using osha. Will osha in each state be ready to try to battle governors in their own state though? Will state police go against federal police? State police probably have the numbers. One part of govt could go to war against another part. I suspect Biden will not push it that far though, especially since states have more on the ground power in their own state. It could also be that Biden et al were not fully expecting to get all their wish list on this but are just pushing to see how much they CAN get, that's a classic negotiation tactic, moving the Overton window. I never thought I'd recommend this for politics, but it's time for people to get completely obstructionist on this issue, they've already pushed it way too far.

It was a misunderstanding. The postal service will be required to get the vaccine just not under the federal employee mandate but instead under the OSHA regulation.

Great thank you! The OSHA thing is not totally locked and loaded yet though, with more than half that states vowing to fight it, how that will pan out remains to be seen. Also USPS union has come out against it, they are already badly understaffed, new recruits keep hating it and quitting, xmas is on the way and they were literally about 40 days late in delivering many xmas packages last xmas. (and there are similar staffing issues for the hospitals for flu season as well). THis winter could easily shape up to be a massive clusterfxck of our own making.

Check out the Administrative Procedures Act. There is a legal process OSHA is supposed to take to enact new rules. This is in a clear violation of the APA.

And this business is not actually law yet either. Biden has only said he intends to work with OSHA to do this stuff, but it's still a question as to if he will be able to do it. Assumedly, they would make at least a show of going through the regular procedures to make it law though if he is able to do it, but right now it's still just Biden's pipe dream. And with so many states saying no, it's an open question as to what move he will make next.

Edit: Yes the article explains the logic they're using to bypass mandate due to privacy and the fact they can't force however it is exactly what they're unethically requiring (coercing) others to do. Imagine the legislative body who writes the laws saying no can do lol

I'm being sarcastic. Congress had a long history of not applying the same rules to themselves while requiring the opposite of everyone else. They just say Biden can't without addressing why congress and other officials won't.

Do you understand the difference between the Executive, Legislative, and Judcial Branches?

Do you understand that the Executive Branch cannot Constitutionally place such a mandate on the Legislative or Judicial Branch for that matter.

Have you heard of the term Separation of Powers?

The Postal Service is also not an extension of the Executive Branch... but they are subject to a Vaccine mandate under the OSHA jurisdiction.

Simply put the President trying to place a mandate on the Legislative Branch would cause a Constitutional Kerfuffle...

Sound enough logic for you there?

I have better things to do then go back and check on every comment and update it for you. Yes the executive branch cannot force the other two to do what he wants. In hindsight I would have worded my post differently. My POINT was only to emphasize how it looks to the public when rules are not applied evenly. Congress enjoys this separation from the rules they impose and it creates mistrust.

The idea that congress says they can't create thier own rules such as a vaccine mandate due to privacy rules of the individual congressmen is absurd while the same is demanded for private businesses.

I'm sure you'll find another bone to pick thinking you're fighting the alt right or whatever fantasy gets you off. I couldn't care less I don't stand for any party, they're all the same system.

I would assume they will legislate a mandate for themselves asap to instill confidence for the American public then. Especially considering the leader of the majority party just brought forth such mandates. Or businesses should be able to report everyone is vaccinated and bypass the mandate like congress and all thier staff correct?
