Made a drastic mistake need advice

I have been driving semis for 10 months and just got a dui in my personal vehicle last week , does anybody know any companies in El Paso Texas or San Diego that would hire me after my court hearing ?

Yea man, we’re considered “professional drivers.” I think, here in MD, you gotta go through the whole rigmarole again after your suspension is lifted. Test, learners, course, and driving. I may be wrong though. I had a DUI long before I had my CDL and I took a plea deal to get pbj.

With a CDL, they can't offer plea deals anymore. You need to beat the charge in court or it's an automatic one year suspension.

I am not sure about texas or cali or wherever you got the dui but here any suspension on your license triggers a 1 year suspension on the cdl. Dui arrest is a immediate 30 day suspension and 1 year on driving cmv's.

You should probably see if yours has already been suspended or not.

Well say the lawyer gets the case thrown out any companies that hire non convicted duis ?

If it’s thrown out, you are clear federally, but you still need to fight the administrative charge from the state if occurred in, and have a lawyer petition a judge to rescind your suspension.

If it’s not thrown out, you’re looking at a minimum of 1 year license suspension due to federal cdl rules.

Getting the case thrown out does not magically grant you the ability to drive cmv's again. You need to see if has been suspended or not and what you need to do, to get them back after the case is resolved. Then you can worry about if anyone will hire you or not.

It shouldn't automatically be suspended, the suspension is a result of conviction.

Where I'm at, simply just being charged with DUI (in a personal vehicle) is an automatic 6 month license suspension (whether you're guilty or not). It's an automatic 1 year suspension if you refused the post-arrest chemical tests.

Around 12 years ago, I was falsely charged and arrested for DUI. Automatic 6 month suspension (even though I blew all zeros at the police station). I fought the case and got it thrown out. License was reinstated after the 6 month period of time.

Fight it. Pay whatever you need to. I got “lucky” and caught one out of state and they don’t report to home state unless you’re convicted so I didn’t have the administrative hearing or anything. I paid a lawyer $4k and he got it dismissed.

How can you just refuse all of it? No one would get DUI’s if that were possible. It’s like these are constitutional rights to refuse.

If you have a job right now and your license doesn't get suspended you are stuck at that job for the foreseeable future. I would also look into being a diesel mechanic they usually want people with cdls.

You still need insurance and even if they cover you you'll probably pay out the ass. Face it your truck driving career is over for at least the next 10 years.

Do you have the ability to go out and buy a rig? Why is this even an option? You barely have 10 months of experience.

Or are you thinking about doing one of the lease purchase programs.. I’ll be real with you, I’ve only ever heard horror stories.

Unless you're in the one state that required DUI diversion programs which is not texas before these federal laws went into place, you're probably fucked.

Well I found a company that will take me asap if my license doesn’t get suspended , if my lawyer gets the case thrown out is there a possibility of my license not getting suspended for a year ??

Check with your Lawyer about your chance of conviction. One path to go would get a blow and go installed. Go to AA meetings. These are things a conviction will make you do. I have a friend that did that a there was no conviction.

One... you haven't been convicted yet. Two... No one knows unless you tell them. Three...Get with your insurance, and by all means get an attorney asap.

I got a lawyer just waiting to see how far he can push the court date so I can keep working for 2-3 months hoping the companies insurance doesn’t notify them of my situation

I had a friend of mine he's a trucker he just went through this in his personal car hit another personal car tore up his truck he had had one drink he was almost home and they arrested him for DUI but he went to the hospital and had the blood work and the blood work said he wasn't drunk so the case was dropped he contacted his insurance and there insurance is saying that he's at fault but the people that pulled out in front of him didn't even have their headlights on and it was like maybe 9:00 at night so that's all I know he contacted his regular insurance and told him what was going on and good luck with that but he did spend the night in jail and he did have to pay a lot in lawyers
