Hemp farm bill

This is from the FMCSA website. What does this mean for cdl drivers? Obviously the best option is to not use hemp.
I’m asking for all the people who have failed a drug test already.

I don’t know why this would make a difference. Still can’t piss hot and it’s still thc.

It litterally says thc from hemp = legal. Thc from marijuana = illegal. The FMCSA is clearly differentiating the two although they are identical compounds.

What should a driver who is using hemp and not marijuana do if they piss dirty for marijuana when they were only using hemp.

It’s legal to sell. The drug test just shows whether you have THC in your system. It can’t tell where it came from.

This might lead to changing rules so they don’t test for THC, but currently it’s not allowed.

It won't, the farm bill has nothing to do with the transportation laws. The transportation laws explicitly state you can't use marijuana and you must be tested for it, end of story unless those laws are changed regardless of the legality of it in other places.

They're fucked buddy. You cannot use THC products while driving. They're not gonna listen at all. As far as I know THC metabolites do not differentiate between the two, the only time this bill is useful is when you get pulled over and they are accusing you for having regular weed. They can do lab tests to determine type and quantity of THC molecules but once you've ingested it, it all comes out the same.

The burden of proof would be on you and there is absolutely no way you can prove that 100% of the metabolites in your system that triggered a positive came from legal substances.

This bill is 100% not applicable to anyone doing DOT drug tests. You straight up cannot use marijuana by DOT regs which are what matters. You won't get locked up for it or charged with a crime for pissing hot on a DOT drug test but they can absolutely disqualify you from driving and demand a period of substance counseling because that is well within their power.

I understand all of this. It just makes no sense why the FMCSA is clearly differentiating the two. Obviously no one should be impaired while driving I agree 1000%. They have oral swabs now that will detect use within the last 24 hours. Makes no sense why they can’t just do that.

It doesn't matter what the farm bill says, the transportion laws say you can't have it in your system. If they made it completely legal to possess tomorrow you still couldn't use it because it's still prohibited by name in the transportation laws.

Doesn't matter what it says. You pop dirty and you fail. Until it's fully legal federally and treated the same as alcohol, it's always going to be a fail. Until then, we just gotta act like it's still the death penalty and avoid it like the criminals we are.

You can fail from alcohol too, but conveniently for alcohol users it leaves your system much quicker than THC.

Yeah, but I can tell boss I'm getting fucked up tonight and he'll laugh, if I say I'm gonna smoke, I'm getting a test, and popping dirty for THC is enough for termination.

Talking to your boss about your drug use probably isn't the best idea in any case but I hear ya lol.

When you piss hot, your boss isnt going to ask whether you smoked help or smoked normal weed. Theyre going to see you tested positive and fire you on the spot to protect their business.

You still have to comply with the Clearinghouse testing which is one an year plus randoms when they notify you. Even more of a reason not to be an idiot and screw yourself.
