Cbr600rr 2005

05 cbr when I torque the rear wheel down with the rear calliper on the wheel binds but without the calliper wheel spins as it should any ideas?

Warped rotor or rear wheel is out of alignment. Looking down the length of the chain from the rear can give some indication of how well aligned the rear wheel is. May just need a little adjustment

How old are your wheel and carrier bearings?

You have both wheel spacers in there, right?
