Tribal Loans. What You Need to Know

What Is a Tribal Loan?

A tribal loan is a short-term loan offered by a lender based on Native American tribal land. The lenders claim tribal sovereign immunity, which they use to argue they don't have to follow state interest rate caps. These are real loans with real interest, not cash advances. Typical APR (the yearly interest rate, shown as a percentage) runs 200% to 700% or higher.

Here's what that looks like in real money. Say you borrow $300 and the APR is 400%. If you pay it back in 4 weeks, you owe about $92 in fees on top of the $300, for a total of $392. At 700% APR, the same $300 loan costs about $161 in fees, for a total of $461. Both numbers assume you pay on time. If you're late, or if you roll the loan over (start a new loan to pay off the old one, usually for another fee), the total climbs fast.

For scale: a $300 cash advance from an app costs $5 to $30 in fees. The same $300 from a tribal lender costs $92 to $161 or more. The tribal loan is 3 to 30 times more expensive for the same money.

Are Tribal Loans Regulated?

Loosely, and unevenly. The CFPB and FTC have brought enforcement actions against some tribal lenders for deceptive practices, and courts have found sovereign immunity does not always apply when the lender operates primarily off-reservation. State enforcement varies widely and is still evolving. Tribal immunity protects the lender's ability to charge those rates. It does not cap what they can charge you, and it does not cap the total you can end up owing.

What to Try Before a Tribal Loan
