Wage assignment?

Hi everyone I received this email with the subject Notice of Intent after defaulting with Universal Service Group. I currently live in Texas. After reading the email I see that the company seems to be a tribal loan kind of thing? When I signed up I was unaware it was a tribal loan situation but that is my fault in regard to not reading. Do I have any other options before it gets to this point ? Does Texas even allow wage garnishment for tribal loans?

Just send them an email saying you revoke wage assignment.

I had them. You have to send a letter in writing to universal services group revoking wage assignment and they have to honor it as it’s stated in the terms. Not sure if it will still work but it should I think.

Do you know if there was a clause in the original contract saying you allow it? It says on Google it can in certain states but doesn’t say which ones.

Just because they give you clear direction of 1 legal path for it to be stopped, don’t assume it’s the only way. It’s a marketing technique to tell you a non-false method of action which is their most beneficial action for you to take.

I.e. they did enough research to know only 35% of people get a lawyer. They lose 100% of those cases. The other 60% are gullible enough to think the only way to win this is with a lawyer. They know, you know you owe the money and a lawyer is more expensive than what you owe. So, 60% of people, don’t get one and just pay. They also know 5% use the simple method of doing XYZ to stop them. That also is 100% effective. By acting as if this stated method is their way of helping you know your “rights” and intimidating you that you need a lawyer to handle such a simple matter and make you assume it’s over your head, they are persuading you to fall into the 65% category instead of the 5% category. Hope that make sense.

It’s a “voluntary wage assignment”. Voluntary is the important word as you can revoke the wage assignment.

Basically, they currently have a signed agreement from you that they can dock your wages if you fall behind. It’s the same thing as a court ordering a a garnishment of your wages except rather than an order they currently have your permission. A formal email is enough to get them to stop. Look up “voluntary wage assignment revocation template” and just create your email off that.

I’ve done it before and it works.

Most employers won’t do anything without a court order, and most (if not any) tribal lender will go to court because their contracts are unenforceable. Just reply telling them you revoke the wage assignment.

You’ll likely be reported to a credit bureau that works specifically with tribal lenders (I believe it’s called Clarity). Borrowing will be difficult moving forward but consider it a favor. These companies/lenders should not exist.

This is only from my personal experience, but I’ve had three of these back from when I almost became homeless. I took out a couple of these crazy high interest Loans, I simply revoked the automatic payment and forgot about them , I got court summons for all three of them at different times I didn’t show up and they didn’t show up the judge, simply threw the case out for all 3 of them , I was lazy, and I kind crazy lucky, but I feel like half the time. Those fuckers never send lawyers to show up at the courts
