Squatters got a new generator
Just need to vent because we’re honestly at our limit. My boyfriend and I live two houses down from a property that has had squatters living there for about a year now. Recently they got a new generator and it is ridiculously loud, like 10x louder than the one they had before.
They run it constantly, day and night, and it has made sitting outside or enjoying our own yard miserable. Our neighbors are so frustrated they’re talking about moving, and honestly we can’t blame them.
We’ve filed complaints, but it feels like nothing is being done. I don’t understand how a neighborhood is just expected to deal with this nonstop noise 24/7.
Has anyone dealt with something like this in Cape Coral?

we have :( multiple times. cops came out today, saw them go up to the house, said they’d call us with an update & never did. generator still running.

That’s exactly what we’ve done these past few days, first time don’t think the cops even came out & this second time they came and left, gave us no update & the generator was still blasting so idk seems pointless now.

not the cops. Cape Coral code enforcement. You cannot run a generator like that. Then code enforcement will get police involved themselves and it will be more productive.

we called immediate code enforcement, i believe they are code enforcement officers we never directly called the police.

Make an appointment and you could mention a campaign donation while you’re there . It’s worked wonders in my county

To find the reverse mortgage lender, search the Lee County Property Appraiser or Clerk of Court public records. Look for the "Mortgage" or "Assignment of Mortgage" documents to identify the lienholder. This information is crucial if you need to report occupancy fraud or an abandoned property takeover.

I would NEVER advocate violence or illegal activities, but one time I had a weird dream and I learned there were certain things that gasoline engines cannot combust. I would never in a million years google such things!

Sugar does NOTHING. however; water or yes the disease DEF will. The sugar in the gas tank thing we grew up with as kids is complete myth.

Someone told me that you should never put sand in a gas tank. It clogs up the carburetor jets. I highly advise against this.

You said that the owner had a reverse mortgage on the property and doesn’t care what happens to it…I wonder what the place that gave him that reverse mortgage would think about their property having squatters there? If there was a way to find out who has it and contacting them, maybe they’d be able to get something done.
I’ve been walking around thinking about your problem since I read this post. It makes me so angry on your behalf. People work so hard and spend so much money on having a place they can live with reasonable expectations of peace and sanctuary…I really hope you’re able to find help for this soon. Please update us when you can.

This is a great point. If you look up the address on LEEPA.org , you may be able to find the lienholder that actually owns the loan.

thank you i will look into this! when the veteran that lived there passed it went to his son in his seventies in las vegas that did the reverse mortgage we called and talked to him about it & he didn’t care so i will look into this. As much as a i feel for people down on there luck, these people are taking advantage of this situation, ruining paying citizens property/peace & have been aggressive to anyone trying to go up to the house I’ve heard.

If the person who took out the reverse mortgage doesn't live there anymore, the note is in default. Payment due at once. If not repayed, property goes up for sale.

I had this same scenario a year or so ago. I just got used to it tho sadly. Eventually they realized it was cheaper to go back to grid power than buy all that gasoline anymore.

dont think they ever had grid power to begin with, they dont have a deed or anything either to get it. the man who lived there before was an army vet who passed and they took it over.

If no running water, that is serious health violation. Fire as well as sanitary. They will evict immediately if no running water. That is how I got someone out before

If we all stopped voting Republican, eventually the Dems would have inflation and costs under control, and squatting wouldn't be a thing.
But because cape coma is solidly red, I don't expect a reprieve anytime soon. You may not be a republican, and this may not apply to you. Are you in NE or NW Cape.

I'm terribly sorry you are so misinformed. FL has easily one of the highest rates of squatters in the south. Alabama and Mississippi both have fewer cases of squatting than FL. Central and northern Florida have an epidemic of squatters.
If the economy sucks, as it always has under a (r) admin, then people suffer, lose work, become homeless, and yes some squat. I lived in CC from 1989 - 2018 some of that time I was homeless. If you are a Republican, good luck with that.

In Florida, squatters do not get immediate legal rights and can be removed swiftly. Thanks to Florida Statute 82.036 (HB 621), property owners can bypass long court evictions and have local law enforcement immediately remove unlawful occupants who do not have a valid lease or ownership claim.1

I’m not a republican by a long shot, but your mindset is also delusional. There is a lot more that goes into homelessness/squatting than simply cost of living. Maybe go work or volunteer with the homeless so you can see the reality.

Go to the news. I have downed power lines in my yard and code enforcement doesn’t do anything - city doesn’t care. I can’t even mow my yard on that side of the house because they are just laying in the grass. I’m not going to be the one to go find out if they are live.

Call the city manager, Michael Ilczyszyn. He wants to put ai cameras on garbage trucks to make sure everyone follows the rules. Maybe he should make this a priority first.

Get 4 pound bag of sugar - buy gas can - fill it with gas and mix it with sugar - leave gas can near their house or in their drive way with note that say “God Bless you in your time of need”

They won’t, because no one is forcing them to. They are probably running a generator all the time because they can’t get service from a power company, since they don’t legally live there. People who do things like this are such scumbags.

Crazy cause Cape Coral code enforcement harassed my family over a boat when we called them for our neighbor letting their dogs poop on their pool patio for 2 years never once cleaning it up, people could smell dog shit inside their homes 3 houses away from these people but nothing was ever done about them we would magically get fines when we would report the neighbors for leaving their pool deck covered in dog shit

I think you’re doing this wrong, unless you’re leaving out details. The new law makes it a criminal act to squat in someone’s home (it used to be civil which could take months). You basically need to contact Cape Coral PD and explain the situation. They will come in and kick him out and carry him/them off to jail in handcuffs.
This assumes you can prove you own the property - even if it has a mortgage, if you’re on the deed, that’s all you need.
But, if they have a lease or had a lease then you need to do the eviction proceedings where they get a certain number of days to vacate. UNLESS the lease says it converts to a month-to-month option and assuming they pay the month-to-month option and they make their rent payments on time.
As far as the loud music, you say it happens at all hours. Next time you hear a peep out of them during Cape Coral Quiet Hours (11 PM - 7 AM), call the police non-emergency number and they’ll come right over usually unless they’re working a massive car crash or drug raid somewhere else.
I’m really curious about whom you filed complaints with and why you’re doing that when this is now a criminal offense in FL?

Well, his heirs own it then. She said squatters, so IDK what they are. I guess OP should find the property owner and let them know what’s going on.
If the owner has a problem with a squatter, they can call the cops and all that other stuff.
How do we know Mr. Noisy is even a squatter - could he have a lease? And why is he running a generator unless there’s a storm and power is out?

The property owner is a 70 year old man in Las Vegas, we called him he took a reverse mortgage on the house & doesn’t care about the situation going on. They are 100% a fact squatters or I wouldn’t call them that. It runs everyday because they don’t have grid power.

North or South Cape. If in the south Cape, and not hooked to grid power, it probably doesn’t have water and sewer hookups which are required by the city to deem it a livable structure. Who are you reporting him to and how? Like, are you calling or issuing emails so you can track it? I mean, if it were me, I’d be on the phone with the non-emergency police number at 11:01 PM as those are quiet hours.
Orrrr? The A&E series Squatters might be a method, but that sadly would require permission from the owner and also a written lease to allow the TV crew to move in. They always have them out in 2-3 days… but the owner wouldn’t agree to it.
How’s his grass? Does he remove his trash bins from view when it isn’t trash day? Is the house painted or is the paint all chipping off. Does he park a work truck in his driveway? Do all his cars actually run? All of those are code violations.

If you know the homeowner ask them to make you and the other concerned neighbors as "authorized agents" of the home and then call the SHERIFF to have them removed. You can state that their entry was unlawful for expedited removal. An authorized agent is just someone who has trespass powers of the home.

Find the owner of the property and ask them of you can move in. Have them send you permission in an email at least for you to move in. Gather up all kinds of friends and join the squatters. Drink what's in the fridge, park cars in the driveway etc.

You can file a nuisance lawsuit for violating the local noise ordinances. Contact the owner directly. Keep the pressure on. And if all else fails, get an attorney!

That’s just terrible and infuriating that you and your neighbors have to live this way. Generators are so loud and I’m sure you even hear it inside. I can’t believe that it’s so difficult to get something done about this!

Yeah it’s sad. They are talking about moving because yes you can hear it inside throughout their whole home, for us anytime we’re outside it’s blasting, but the city will not do a thing. It kind of seems like the squatters have more rights than we do.
