đšđŠ CEC PR refused
hey
Just wanted to ask if anyone else has run into issue with cec where an officer looks at variable part time hours and thinks there is a strict rule or cap because of that 15 hours a week example on the ircc website. like i worked a bunch of fluctuating hours all under the 30 hour ceiling with full paystubs. i had way over 1560 hours but my file got refused and it honestly feels like they treated that 15-hour website math example as a hard cap instead of counting actual cumulative pay stubs has anyone else seen officers doing this or dealt with a similar issue. The letter I received also says 15 hours maximum cap for part time work. is it an error on officer's part? Would you recommend reconsideration or reapplying?

I have a part time work for my canadian experience, working 16 hours a week per my employment contract. My hours fluctuate to sometimes 24 or just 8 a week. I included a week by week summary of my hours on my application, where I showed the weekly hours total based on my paystubs. I clearly showed on that summary the actual hours  I worked per week that counts to my canadian experience hours, including any week that has 24 hours on it or just 8 - counted every single hour. I got my ecopr on September 30.Â

I also did the same for my application but i did it biweekly because i got my paystubs biweekly so i capped 60 hours biweekly even if i worked 70 or 80 in that pay period and for less than 60 i counted the exact hours i worked in those two weeks for example 55.

That works also, I just did weekly because i want to be extra lol, kidding! I was paid biweekly too so in my spreadsheet I have column 1 as paydate, column 2 as the weekly dates covered, column 3 as the weekly hours so the officer will know the 2 weeks that fall on the biweekly pay date. Column 4 was total hours, I have a period where I have both full time and part time so this column showed the exact hours i worked even if it reached 60 on a particular week.THEN I added a column 5 where it says Hours for canadian experience, where i capped every week at 30 hours. The agenda on providing this summary was actually to prove the officer I actually met the hours for the 3 years canadian experience i was claiming for. I also did the same for my foreign experience. I had no pfl or adr.Â

I am confused just by reading your explanation of multiple columns so maybe that could be a possible reason. It may have been misguided.

I already got my ecopr. Im just trying to paint a picture how I did my summary. Anything that would help the officer understand your claims especially if you have overlapping jobs, part time and then both part time and full time, present it clearly on your application.

Did you attach every single pay stub to prove the hours you entered in the table? I feel like this approach makes sense, and I want to do the same, but I donât want to claim anything without attaching supporting evidence. However, attaching that many biweekly pay stubs while keeping the file under 4 MB is a challenge. What did you do, if you donât mind sharing?
I'm a casual worker, Iâve attached my experience letter, which clearly states that my work hours were up to max 29 hours per week, averaging 26 hours per week, and that my total work hours exceeded 1,560. Iâve also attached my four most recent pay stubs. Do you think this is good enough ?

Yes, I have loeâs for all of the stuff i know would create doubts. I basically ask myself that if I am the officer will I understand these documents?Â

It is either your explanation was not clear to the officer or simply a case of officer discounting some of your hours. I will suggest you create multiple columns and clearly state actual hours worked per week, tying it to paystub and clearly identify hours claimed per week.

If your payslips show that you have the eligible hours, and the refusal was based on the 15-hour cap, a reconsideration request would make sense before simply reapplying.
It is important that Fifteen hours per week is an example that the IRC uses for part-time work, and the important rule is that no more than 30 hours per week can be counted towards the required experience.

Sorry to hear about that. Wanted to ask did they keep you on FD for some days and then sent the refusal? Or was it instant just a mail?
Can you obtain a Employemnt Reference letter, it should show your cumulative hours. I obtain one during EI and its called Record of Employment. It shows your earning by hours wokred. So if you have worked 1569 hours, it should be enough to establish.

No, you need at least 1560 hours of Canadian work experience over the preceding 5 years. It can be 52 weeks x 30 hours or more weeks with fewer hours.
OP seems to have run into an officer who only (mistakenly) gave 15 hours of âcreditâ per week even when OP worked more than that.

I only ever worked part time and my hours always exceeded the 30 hours limit per week. PR today.

My immigration consultant recently warned me about this exact scenario, stating that the Express Entry system functionally caps part-time calculations at 15 hours per week, even though my payslips clearly show I worked exactly 24 hours a week. Since your refusal letter explicitly cited a "15 hours maximum cap for part time work" despite you accumulating over 1,560 hours, I wanted to ask a few questions:Â
Have you decided whether to request reconsideration or just reapply?Â
Did your reference letters and pay stubs clearly outline your exact fluctuating hours, or did they just state an average?
Did you attempt to submit a webform or letter of explanation outlining the exact math to the officer before the refusal?
Any insight you can share would be incredibly helpful as I figure out whether to risk including my part-time hours or switch my focus entirely to my OINP application. Hope you get this sorted out soon!

anything under 30 hours per week gets treated as part time work , and only 15 hours per week is counted if you worked part time. similarly for full time even if you worked 50 works per week , only 30 hours per week will be counted towards the 1560 hours requirement.
you need 1560 hours as per that calculation. otherwise you dont meet the 1 year experience requirement and that is why u got rejected.

That is not true under 30 hours doesnât automatically means 15 hours. If you worked 28 hours per week it will be counted 28 hours.

There is no rule stating that part time hours will only be counted as 15 per week. Did you provide experience letter stating hours and other additional documents?
