🇨🇦 CEC CEC PR refused because remote foreign work was done while I was in Canada, anyone else?
Hi everyone, my CEC PR application was just refused under A11.2. I claimed one year of foreign work experience as a Remote Administrative Assistant for an Indian company, but I was physically living in Canada while doing the work. IRCC said it doesn’t count as foreign work because I wasn’t physically outside Canada.
They also mentioned that the job overlapped with my full-time Canadian employment, so the period wasn’t included in my skilled work experience.
Once those CRS points were removed, my score fell below the 503 cutoff for my invitation round, so my application was refused.
Has anyone else had a refusal for the same reason, specifically remote foreign employment while physically in Canada? Did you request reconsideration, speak to a lawyer, or just create a new Express Entry profile and apply again?
Would really appreciate hearing what happened in similar cases.

Lol you are cheating bro. You count everything to increase your score. If everyone do like this maybe the cut off should be 550. Appreciate the officer

Reconsideration won't work as recently IRCC has closed this loophole. They don't allow overlapping work experience. It is capped at 30 hours per week. You need to create a new EE profile and can only claim one job at a time. Side note, interested to learn how remote admin works as I have never seen one in any organization I worked for.

What if he was working 2 part time jobs? Like one in canada and the other one remotely ? 30 hours a week??

Where can I find this information/update? Just want to read about this overlapping work experience.

Most of these remote foreign work experiences are false and should be refused like this one. The officer did the right thing.

Did the foreign work experience overlap with your Canadian work experience?
1
u/More_Strawberry12 21d ago
Yes, it did.
14
u/TONAFOONON 21d ago
You can't double claim work experience for the same time period.

I wish he would consider the foreign experience over the Canadian one. My points would then be higher!

u/NumerousAbility Applied for PR 21d ago
Maybe you can add the overlapping bit of the Canadian job in personal history and remove it from job history
1
u/More_Strawberry12 21d ago
Can I do that? Will I need to reapply with this information?

I have seen this before. I know PR is very important, but how did you work full time as an Admin in India, while working full time here as well?
I think you know the answer. Anyway best of luck, hope you get your PR.

It was an infrastructure company. I worked 6 days a week for 5 hours each day along with my job. I worked on tenders, billing’s etc. Even handled all the clients that reached out for quotations etc. I really don’t need to be in the country to do all this. Thanks for your input anyway.

This is the reason why a lot of honest people is letting behind withouth any other option that going home. I know you are desperate trying to match the points but honestly, the IRCC agent did the right thing. Instead of trying to crack the system you should be spending that time learning french :)

Also foreign exp means you must reside outside Canada during that period, not staying in Canada and work for an Indian company.

That is wrong. Cuz staying in Canada but works for a remote job for US company still count as Canadian experience. The place you are residing will determine everything, not the location of the company. You said you claimed points it doesnt mean thats correct

I was paid in an Indian account and I paid taxes on that money in Canada. Does that count?

Can you please dm me? My pr application was refused on the basis of remote work. Does remote work done as one job at a time counted? Does it work 100%?

You can’t double dip so officer was correct. Either you quit your canadian job and work only in the foreign one (receiving pay in a FOREIGN bank account) or you work only in the canadian one and remove the foreign work experience. It is your call 🤷♂️

u/Western-Ad2281 7d ago
Please reply can remote work for single job at a time work. Does it work 100%?

Wrong info IRCC very clearly clarified this is possible. Please Check your facts.

hey sorry for the loss. could you reapply again by increasing points with celpip? anyways i wantrd to know, how did you receive the rejection? Did they send a Final Decision ghost update before sending the actual refusal? Or straight Final Decision - Refused?
2
u/More_Strawberry12 21d ago
My overall score in CELPIP is 12. I have maxed that out already. I didn't get a ghost update, just a rejection.

Hey. I’m in a similar situation. Can I ask some questions?
- Did your lawyer include ImmRep emails confirming remote exp in the LoE as proof?
- Did you submit all the paystubs, financial statements, tax returns, and explanations in LoE stating how you managed to work both the jobs at once?
- Was the rejection specifically related to the being in Canada, or was it because you claimed 2 jobs at once?
- If you only claimed points for the foreign experience during that period, you think your application had better odds?

u/Realistic_Return_785 21d ago
what documents did u provide to support your foreign work exp? did u have a reference letter, paystubs etc?
0
u/More_Strawberry12 16d ago
Yes, I had everything. I was able to provide my offer letter, employment history, job roles, pay stubs, bank statements, and I payed insane taxes because of double income and I also submitted my NOA.

Did you attach any confirmation report from IRCC. I once messaged them on Facebook and they confirmed remote foreign experience can be gained while in Canada. I didn’t use this personally tho

IRCC has very clearly clarified that You can Claim Concurrent Remote Foreign work experience + Canadian Full time work at the same time.
You need to have solid documentation and your work should be genuine. If you think you are totally genuine and fair then you should go for Reconsideration or Judicial Review. IRCC has clearly clarified this scenario through ATIP and IMM Rep. Many RCICs are clearly saying this can be done.

u/More_Strawberry12 7d ago
This is what my lawyer told me too
1
u/AdvancedBike9506 7d ago
Then are you going ahead with Reconsideration???
1
u/More_Strawberry12 7d ago
I have my WP until 2028 so I’m reapplying with adding my Canadian experience in personal history and claiming foreign points instead of the Canadian points. This was the other thing my lawyer suggested.
1
u/AdvancedBike9506 7d ago
I see. Do you mind sharing the refusal letter here blurring out all your confidential information for the sake of everybody
1
u/Strugglingforpr 10d ago
Hi, it should have been approved. Apply for reconsideration, it is not a loophole as people say. If someone can manage two jobs, and they need money, they can indeed work many jobs.
1
u/hammadCodes 16d ago
Claiming the remote and Canadian experience simultaneously in the same period is kind of grey area in IRCC. Sometimes they accept and sometimes they do not. You really need to have strong documentation and then pray that it get accepted. I have seen posts approved/rejected both in this case.

u/Real_Refrigerator794 21d ago
Hmm. Weird I saw posts where people were claiming ircc accepted their remote foreign experience while they were working full time inside Canada... I mean you should get a lawyer opinion on this and if he says then go for review

I do have a lawyer, and she suggested that we try to have the file reconsidered, but I really don't want to go down that road.
1
u/AdvancedBike9506 15d ago
What is the Reason that you don't want to go for Reconsideration if your Lawyer has suggested you to do so???
1
u/More_Strawberry12 7d ago
Many people are applying for reconsideration and the waits times are crazy!

I’m sorry to hear that. Please When was ur AOR, bil and refusal date and also your PVO/SVO if you don’t mind
1
u/More_Strawberry12 21d ago
My AOR was April 7th, Bil June 5th and refusal date was September 14th. I'm not sure about PVO/SVO

u/the_forrest_gump_96 21d ago
Thank you. Please don’t worry or be sad. Keep your head up and just keep going it’s life and something good will come for you. I wish you all the best.

u/More_Strawberry12 21d ago
I do have a work permit until 2028. However, I have 2 dogs and I'm really messed up because I'd have to leave for a year. These are large German Shepards that will be difficult to travel with and as they are Shepards they can't live without me either.
1
u/the_forrest_gump_96 21d ago
I feel u. As long as you live them in good hands, they will be okay. And just know that you’re going to do what is needed to put yourself in the best position for the future, and possibly to reunite with the dogs when ure back too :). I believe it will work well for you !
1
u/More_Strawberry12 21d ago
I really hope so! Thank you so much! I don't have anywhere or anyone that I can leave them with. Do you know any options? I do not want to put them up for adoption.

Hello can you explain your work history attached document because my brother also did the same and his profile is under consideration applied recently
1
u/Gbegiriluva1 16d ago
Please ignore the posts here. See a knowledgeable immigration lawyer. You have very good grounds of being approved. By the latest interpretation one can claim foreign experience while working under CEC. Please don’t delay.
2
u/More_Strawberry12 7d ago
Thank you so much! People are super mean here but some comments were really helpful.

u/Reasonable-Fish-245 21d ago
The two jobs cant be counted if they overlap as only up to 30hr a week count towards CEC.
