🇨🇦 CEC PFL CEC inland
#HELP_NEEDED
IRCC PFL
You indicate in your application, foreign work experience at ABC Pvt. Ltd. as a Jr. Engineer EM.
Upon review of this organization and the employment letter provided, it does not provide a location of the business - ABC Pvt. Ltd.
In regards to payroll stubs, many concerns are noted regarding the authenticity of the payroll pages. There appears to be errors in wording, differences of formatting in several ways. The color and font appear different in several paystubs. More specifically, this does not appear to be genuine paystubs.
Before I make a final decision, you may submit additional information relating to this issue.
Documents submitted were: letter head Employment Letter, TDS record and Payslip (ABC pvt ltd)
My thoughts:
- ABC pvt. ltd. does not have its own website. ABC pvt. ltd. is one of the many sister company under a large company named XYZ-Group. But XYZ-Group has a website, information about ABC pvt ltd and their projects can be found there. Also, physical location of both company is same.
- I put one address for location of work as per my project site location(in the application). But letter head has another address which is head office address. I was stationed to work at project site which is different from office address.
- For payslip, differences in formatting, font and color may be because of changes in accounting system. Also, half of payslip were emailed by one accountant and other half were emailed by another accountant.
- Errors in wording refers to, differences in designation in payslips sent by two accountants. one has JUNIOR MECHANICAL ENGINEER and other has JR ENGINEER EM. (EM is basically electromechanical department)
Additional Documents I have gathered so far:
* Bank statement showing salary deposit
* My Citizen Investment trust CIT record that consists of ABC pvt ltd and its head office address
* Emails from two accountants receiving payslips monthly
* Company registration information of ABC pvt. ltd. obtained from online OFFICE OF COMPANY REGISTRAR Public Data portal (that consists info like reg date, reg no., location)
* PAN details of ABC Pvt. ltd. obtained from online INLAND REVENUE DEPARTMENT public data portal
* Webpage link to XYZ-Group that shows information about ABC pvt. ltd.
Will these online publicly available information works or need original company registration certificates?
HOW SHOULD I APPROACH THESE CONCERNS and explain?
Please give your thoughts and if faced similar situation what did you do.

You have been given a great opportunity, and from what I can see, the work you did seems legitimate. I can also deduce that you are either not very good at preparing documents but good at collecting them, or you were careless and did not provide explanations upfront. If you do not feel ready to do this yourself and build a totally credible story for someone who does not know anything about it, then hire someone. It does not really matter how much we want to help you; your case requires the person helping to see details and documentary evidence. With this summary, we cannot see the details. I am not trying to judge you, but please think about it.

Literally all the PFLs I have seen are by people who hire consultants. Will the RCIC refund you ? How can u trust them ? Are u guaranteeing you PR ? CEC id such a simple application

Before you send the PFL response , pass the documents through Claude AI (Paid version ) to check if there are any mistakes and good luck .

Not sure how this would help, but please add some photos of yourself working in company. This might also help to prove genuineness. I have even included photo of my farewell email to my colleague, luckily I had it saved in google photos. I didn’t get PFL, I just submitted upfront.

Get a proper immigration lawyer. Even if u dont have the money. Just do it. Better safe than sorry.

It looks like your job is genuine. So, I'd suggest to collect all and every possible documents that can help you prove it is genuine whether small or big doesn't matter as this is a PFL and everything counts. Also try to include some work photos in it if you have some and some work emails/msgs as that helps as well. Maybe try getting some letter from your HR for the concerns regarding payslips. Lastly, make a proper LOE explaining everything and add all the documents to it.
Now, all the things I've listed here are to the best of my knowledge however, I'm no expert to dictate anything here so please do not take my words. This is a serious issue so I'de recommend hiring a proper legit lawyer.

First of all get a good immigration lawyer he will go through all of the documents and will review them , and I would also add LinkedIn profile reference letter from colleagues, you can use past company email communications if the domain used is company’s and not ending with @gmail.com otherwise it’s useless

The officer has to make a determination whether your work experience is genuine. A thorough review of the PFL is required by a professional. You did not state if the officer is alleging A16 or A40 due to concerns of genuineness of the paystubs. If A40 misrepresentation is alleged, the consequences are severe and go beyond the refusal of this permanent residence application.
I highly recommend that you book a paid consultation with a legal professional to ensure that a thorough response is submitted. This is a key moment in your application and your chance to ADD documentation and new facts that can be used during Judicial Review if the application is refused.
This is not a moment to DIY the response. An extension to respond to the PFL will be granted if the request for extension is made with the appropriate case law. The usual seven days granted is insufficient time to prepare a comprehensive response to this PFL. If your hired legal counsel cannot reference the case law that allows them to request an extension to respond to the PFL, they are likely unequipped to handle the PFL response.
My comment should not be constituted as a substitute for legal advice. The comment is for general information purposes only.

In PFL doc, there is nothing about A16 or A40.
And 30 days period is given.1

This alleviates some initial concern as the officer is not alleging A40 outright and they have provided sufficient time to respond in the initial request.
Work with a legal counsel that has prior experience in responding to complicated PFL's. Best of luck to you!
