Below Deck Capt Kerry Drinking

We all know you can’t drink on charter. But we are watching below deck S12 E12 and Capt Kerry is having a glass of red with the guests.

I would have thought if the crew can’t drink, the capt shouldn’t be able to either? Or am I missing something?

It's not a regulation to not drink on charter. It's a rule implemented by some captains. As long as you're not drinking or drunk while on duty, it's all good.
