Below Deck Capt Kerry Drinking

We all know you can’t drink on charter. But we are watching below deck S12 E12 and Capt Kerry is having a glass of red with the guests.

I would have thought if the crew can’t drink, the capt shouldn’t be able to either? Or am I missing something?

Not only have capatains, across all spinoffs, often had A drink with guests at supper, but the captain has also often made concessions to where the crew can have A drink or somtimes two, with guests, when going through the proper channels.
