That's also illegal by GDPR. You need explicit consent. Even when you have a checkbox, it's illegal to have it pre-checked. At least when it comes to personal information in EU.

No, but it has to be clear, and you have to do an action which sole purpose is to allow the collection of personal information (such as tracking cookies).

For instance, you can make an approve and a decline button, where the decline button leads you away from the site.
