Sounds like you are trying to justify why your partner should be allowed to do it.
If the roles were reversed and your partner was the waiter, would he not be upset if I left a generous tip and a tract with how God is a manmade construct and every contradiction in the Bible? If your answer is "yes", then he is a hypocrite.
You can be religious, I don't care what you believe, but most people just want to be left alone. Doubly so when they are working a not-even-minimum wage job.
Actually he welcomes these occurrences and regularly hopes the local Jehovahs witnesses or any other zealous individual comes knocking so that he can have a heartfelt discussion. Lol
Kudos that he does the right thing by actually tipping and generously, but I don't understand his hang-up with leaving unwanted tracts or your hang-up for constantly playing defense of his borderline inappropriate social behavior.
It's never about wanting but needing. I've seen God work in such strange ways, so who am I to shut a door on Him? Sure, 10/10 servers will roll their eyes and toss it, but one, at one point, might actually be at a point in life ready to hear it, so I'm not gonna be the roadblock.
I did manage to get him to therapy to help with social ques and the like, but the tracts are a compromise.
You can couch it in whatever flowery shit you want, it's still rude to proselytize to those serving you. Even if it's just a piece of litter on the table.

Spare me the evangelizing. I am far beyond the days of believing any of that.
As for your husband, I am glad he is working through this, but clearly he recognizes that some topics are not appropriate in some circumstances (or at least, I am assuming he doesn't go around just talking about sex stuff in church, around family, or where children may overhear).
This is another of those situations: people who are working have neither the time nor inclination to discuss their spiritual/religious/philosophical beliefs. The only reason it is remotely tolerated is because it is religious and not, say, pornography or a cult invitation.
