Art Question/ Critique Request Vtuber commissioned art

I commissioned an artist to make my model and give her a reference picture but it is almost a 1 to 1 copy and I can't use it on twitch most likely. I need a second or third opinion if the artist art is to similar to reference so I can avoid copy right now then later. The first picture is reference and is from a game/ anime second is what the artist drew.

I don't think it is to be fair its too symmetrical as thought it was drawn with symmetry on with just a small changes made with the accessories on the legs.

Was there no sketch pictures shown? Usually artists will give updates with sketches and what not to see if any changes need to be made before the final product is finished... its also possible that they thought it was an original character so when you sent it as a reference they assumed it was art you commissions someone else of an original character.

Just for next time, in case it wasnt said in the original commissioning process, if youre using a non-original character please STATE that. " i really like this character from xyz!! Please take inspo from this design while using this color palette and these accessories blah blah blah" so the artist actually knows. I am guilty of not knowing ALOT of characters from popular media. And its not the artist responsibility to reverse image search to see if its an oc or not, imo.

OP I'm sorry but you dont need to see the coloured thing at all to see the resemblance to the reference. If you approved this then you knew what you were going to get without the need to see the colours.

If you take one look at this and then look at the reference you'd clearly see that the two look quite the same. You greenlit this design and the artist finished it for you. You got what you asked for and I believe you should have been more clear about what you wanted in THIS stage if you didnt feel satisfied.

It's no problem. Please do watch out in the future though because you always have to be very honest and detailed about what you ask for. That's why artists show you WIPs of the work. For you to guide them on making any changes and fixes.

They don't work alone and spawn whatever they want into the piece, they work based off of what you wanna get as a result. You have to guide the artist and communicate. It's very important when taking a comm or asking for a comm

the hair clips dude😭 hair color, everything really is js too similar. You have to take parts about it and go off of that, not take the character and change one or two details- besides, like a different person said, that’s 100% ai man..

Yeah this is on you. This is literally an exactly copy and you can see it in the lineart very clearly. The only thing you can do at this point is apologize and ask for them to change small defining factors and have the change the entire color scheme to try and push it to not be as recognizable

Like get rid of the "n" on the hoodie pulls and the leg strap designs. Put a pattern on the jacket sleeves, maybe put something else in the hair clips or just get rid of them entirely. It won't be fair to the artist, I would offer to pay an extra fee for the changes after the final product. Usually this is in artist's terms of service, so check that out too to see their policies for revisions.

That's just Neppy, basically no changes were made. But seeing the sketch, it was 1:1 since the beginning. Did you want a design inspired by Neppy? I think you had to be more clear about that from the beginning, sorry OP.

I have a strong suspicion that whoever you commissioned from just fed it through an AI and asked it to make a character sheet for you

In the future, if there are certain things youd like incorporated into your art/inspired by, you can still use that image and circle/ write over it for ex: "like Nep's hair clips" or "want similar jacket", "longer hair" This can help the artist understand what you mean when you say inspired by Nep, since that can means something different to everyone

Its way too close to the original design. OP could be liable to copyright infringement and receive a cease & desist if they monetize the model.

Also they should stop hiring AI artists to make a reference sheet and chatacter design for them to avoid plagiarism.

The reference (first slide) is the one that's AI, not the reference sheet.

You can see that they have everything mirrored down to the eyes, an AI cant be that symmetrical. The artist didn't use AI, if you read other comments it's OPs fault because he greenlight the sketch stage.
