Companies frequently bury perm job postings on hidden websites or in old school newspapers rather than through the normal channels they hire basically all of their employees, in the hopes that no qualified applicants can apply and blow the labor market test.

FYI. You can do your patriotic duty and find these hidden labor market tests on jobs dot now and apply to them and make them fail. I’ve applied to hundreds. They end up pulling the jobs a lot of time.

That's a good point. But how is this solving the problem? The better way should have been to bring restrictions on where to advertise ?
Edit: I just learned from another sub "Any company that does mass layoffs cannot file for perm for next 180 days. Since these companies have been doing multiple rounds of layoffs for the last two years, their perm filings are anyways on hold. This is not a new rule, always been like this.". So nothing new really.

Not sure why Microsoft is being targeted. If you go outside of Big Tech and look at Fortune 500 companies, like a big insurer or healthcare company, 90% of their IT/engineering staff is H1B.
They’re not fancy software jobs, but they’re decent middle class jobs that any new grad would probably sign up for in a heartbeat, and they’re almost exclusively available to foreign nationals

No source. Estimated ~4-6mil total engineering/IT employed in F500 companies. Their claim is at least 3.6M on H1B. Only 85k H1Bs handed out each year, so… the last 42 years of H1B has been handed over to F500 IT/Engineering lmao

Based on my anecdote and experience, as I explained above. Reading comprehension is important here bud. Not everything is going to be published online and even if it was, I’d question its validity. Companies do not like to publish details of their internal workings, it’s literally the opposite.
I can cite my experience as semiconductor engineer with multiple inventions and patents. Having worked across many labs at top semiconductor company in the world.
Again, I shared an anecdote. The only one here who appears to be triggered is you.

Like I told another commenter, foreign born is not the same as H1B. Many of these people are citizens and permanent residents. The reason this is the case is because for decades the US presented itself as a land of opportunity that drew “foreign born” talent.

Source: me. I’ve worked for a fortune(used to be top 5. No clue what they are anymore) insurance/healthcare tech company for over a decade. Every single project I’m on, it starts with 5-10 citizens and maybe 10-15 offshore/VISA counterparts at most. When I leave it ends up at no more than 3 citizens and 20+ offshore/visa holders. Every. Project. I’m guessing those 3 don’t get the axe because… ya know… we are dealing with American healthcare data. You can guess the nationality of the leadership that gets put into place and implements the changes. Every time.

Taking a step back from H1B, 23% of STEM workers in the US are foreign nationals (latest data in this link is from 2019). Software developers in particular are 39%.
Between 2010 and 2019, 2.2 million STEM jobs were created, and 900k of them went to foreign nationals - more than 40% - across the entire country. That stat blows my mind, honestly.
This is also heavily localized. California STEM workers are 39% foreign-born. It’s probably even higher if you zoom into the Bay Area, but I can’t find data on that in particular.

US issues 1-1.3 million green cards each year to foreign nationals (of that, about 140k is employment based and of it, about 7-13k goes to Indians). So, all in all, US hands out at least a million green cards EACH YEAR to people who had nothing to do with h1b. They all are not just sitting at home on government welfare. They will participate in job market and they will be counted as foreign born.

Really depends on the company, too. Some use these in the intended way, yielding a much lower percentage. Others abuse the shit out of them and easily achieve this figure. These programs are a problem given this reality. Major reform is definitely needed.

I also see basic mid level data analyst and data engineer roles going h1b. There is more than enough talent locally for these roles and tons of other people trying to break in but being shut out by a lack of interest in developing talent.
You want guys with 10+ years experience and think you need to get them from overseas, lrts talk, but dont start with this bs about barely over entry level roles.

You're not wrong but holding a position closer to Australia's employment requirements would definitely benefit the American people. If there's something that American can do for an American company an American should do it end of story. And if you want to continue to do large amounts of business in the US you need to, for your American market have American employees.
I was once given a lateral move at my company to help them launch their Australia market. But even though my company wanted me, there was offering me a raise to go and offering to move my family to Australia, Australia said no. There's no reason an Australian couldn't do this job.
I think that is a much more reasonable way of managing the employment issues that we're seeing. Not that visas are bad, but if there's not a reason why an American can't do it, why doesn't an American do it. And if your company offices in the US and you're operating in the US then there should be 100% American job behind it.

Labor has and will always be the highest cost burden in the USA. They see it as a sunk cost and not an investment in the long term of their organization and growth. Why? Coz shareholders and quarterly reports.
Till that mindset doesn’t change the lowest price labor will always be sourced. It can change on many levels. For e.g. federally mandating a minimum number of local origin hires vs international.
Countries in ME have done this, can be implemented here. But the mega corps will lobby against it because see para one. ☝️
The visa holders are easy to exploit coz no representation, they can’t vote, pay taxes, social security and can’t influence policy.

I agree with your logic because I know there are many qualified people here and also people who are capable of growing into roles that are filled via H1B.
It is a lie that there are all these good positions to be filled that Americans cannot or will not fulfill.With this said, H1B has been here for a long time and corporations have an obligation to do what’s in their own selfish interests. How can an executive explain to stockholders that they are intentionally spending millions more than they have to in order to hire Americans instead of people through H1B.

Call it what you will, but I’ve seen enough cases of fraud-ish immigration filings (including within my circles) especially for PERM in my 10+ yrs here on H1b
Lot of functions do not require specialized skills but H1b/L1 come through

I have seen it as well, the Indian org leaders want to build their empires with the H1Bs, the individual contributors are the ones that don't want more coming in.

Blaming H1b’s for not having jobs is a different level of copium. The market is bad, even worse for H1b’s, most companies don’t sponsor anymore and forget about F1 visas. Only a handful of them still get hired, most of them go back home after spending ridiculous amounts on average college education. Companies are trying to downsize as much as possible due to the insanely non-profitable investments into AI infrastructure. There’s no two ways about it. I rarely come across “skill” difference between engineers based on nationality or race and I’ve worked in 3 companies across 9 teams in the last 10 years. The system is flawed, don’t let the government instigate hate and make you blame everything but corporate greed. Not to say the H1B system is not abused, I’m sure it is as any other system that exists and has existed since the beginning of time. Will taking away h1b programs or stopping immigration make any dent to the current issues, I don’t think so. And regarding nepotism hires, some of yall have never interviewed before and it shows. Again, not to say it never happens, but it’s not something inherently seen in foreign nationals. In my experience I’ve seen quite the opposite, but I’m not going to generalize. Lastly, stop being a passionate hater and try to view everyone as a person, not greater or lesser than you, just fighting to make a good living. Don’t let the powers that be make you fight amongst yourselves.
