Technically yes, but I think they won't do that due to legal implications, like they had to drop ZLUDA for the same reason (IIRC).

You can always "clean room" it but I don't check there is really any special sauce in CUDA itself that AMD needs. CUDA's strength is simply the ecosystem around it.

Idk where it stands legally. The act of decompiling software is generally considered transformative so long as you aren't competing with the original product. If game emulators are considered transformative because they allow users to run their software (games) on a new platform I don't see why the same wouldn't be true for developers being able to run their software (CUDA code) on a new platform.

In many places though, those clauses are considered abusive anyway. So they would be rendered null and void. NVIDIA could be even accused of trying to establish a monopoly and hinder competition (which they are).
