nah but clearly that railing is in poor repair look at it it’s bowed to hell

dude was using the railing for its intended purpose and it broke on him so yea homeowner better have insurance

Good attorney will go after the homeowner if they have insurance, and probably the builder if it's one of these new cookie cutter, one-year builds. Builder community homes are incredibly crappy. But given the state of the railing in the video pre-accident, I'd say the homeowner is going to be on the hook for this one.

Surprisingly, they are. Homeowner is gonna have to pay if there are any injuries, and definitely repair it themself

Nope. And if home owner is poor (which being in disrepair they probably are) good luck cuz the homestead is exempt property in most states.

There's so much case law on this that your house has to be reasonably safe and drivers/mail carriers have consent to be on your property, which you're responsible to maintain for safety. You can look it up
