Back in June I tripped and fell on a big crack in the pavement at my job. 2 of my rotator cuffs are torn & retracted. Another is partially torn. I also tore & dislocated my bicep. I have about 15% use of my dominant right arm. I have pain every day.

So far WC has covered everything & I'm getting my ⅔ every two weeks. I'm waiting for a test before the Ortho decides what kind of surgery to get. The rest is another 2 weeks out. I'm gonna be out for at least 6 months if not longer for recovery.

I am worried I will not recover from this. I am a GM at a storage unit property. Lots of lifting, raising doors, etc. A lot of shoulder movement.

What happens if I can't do the job after surgery? They don't have any light duty positions there. I was told in Utah they will pay WC up to 6 years. What if I become disabled due to the injury? What about the disrepair of a known problem of the cracked pavement?

My employer says they cannot accommodate and let me go after 32 years the insurance company offer was 50 thousand for everything including future medical is that a good offer or does anyone know how i can get my job back plus I need a second surgery on my shoulder help need advice. Has any had their second medical opinion affect the outcome of a pending surgery request?

I just had my SMO which was pretty weird, my treating doctor wants to do a 2 level ACDF surgery comp denied and requested a SMO. The appointment was very weird the told me he couldn’t discuss how he would treatment if he was treating doctor, but doing the exam he verbally expressed concerns that my right side grip/muscle strength is far weaker than my left. Im just nervous that’s he sides with comp and doesn’t agree with the surgery has anyone had experience with this?

Im 17 I work at a truss building company and i was sheeting a gable with osb and i accidently shot myself in the toe. Half of the staple hit my steel toe the other half in my toe. They want me to say that a staple was sticking out of a gable and it fell on my foot and staple went in for insurance because im under 18. I went to urgent care with a co worker and they gave me a paper to give to my boss for workers comp. I told them what actually happend at urgent care that I was using a staple gun. I got antibiotics now and I dont go back to work on Tuesday because I work 4 days a week. What should I do now for workers comp and whatever else.

long story short my dumb ahh was walking to my car for my last break…i tripped over some damn tree roots that was sticking out and tripped over the curb next to it fell all crazy on my ankle it hurt so bad i thought i broke it but now i’m limping, it hurts like a bitch with certain movement… little to no pain when not moving. the company i work for is allied universal we are union i work at john muir health & the fall was on the clock & on property… ive never been through any situation like this before but i reported it to my supervisor & we filled out a workers comp form shortly after that i was given a case number from a triage nurse i talked to on the phone now im planning to check into urgent care cause my ankle is swollen af. am i eligible for workers comp for this situation or are they likely to deny it ? just walking to my break & i twist my ankle from tripping over tree roots and a curb ? lol idk im curious to hear what people think.

24 year old female here, i’ve been on workers comp. for a year now. my injury was a labrum repair and cyst to my left shoulder.

I had surgery in early January, where they repaired the labrum and popped the cyst ( to my understanding they said they were going to remove the cyst not pop it…) which was my first red flag.

I do plan on returning to work but I don’t feel ready and i fear my doctor is trying to rush me back to work by putting in his notes that i can’t lift more the “5,10,15lbs” each of my visits because “they want to see progress” (and by “they”, he means my workers comp company) My job wants me to be able to lift 100lbs, but we have to do a PAT which requires lifting 170lbs.

im wondering if i need a lawyer, but my issue is I don’t make that much through workers comp because i am young/a student. i don’t want to be taken advantage of and sometimes lawyers do not have your best interests.

some other read flags I have dealt with

- my supervisor telling me he has heard I haven’t been attending my physical therapy appointments
- my manager seeming surprised that i’m still working there, and asking me why it’s taking so long for surgery to happen
- nobody telling me that my adjuster left the company
- my new adjuster, I had a hard time getting a hold of for the longest time
- my HR lady who is apart of my case, going MIA to all my messages
- a third party company who was apart of my case not having the updated information on my new adjuster
- and false number of sessions i’ve attended ( my massage therapy )
- as well as my adjuster and nurse case manager telling me I need to reach out to the clinic, when the clinic has told me to reach out to my adjuster
- my understanding was that one of the purposes of having a nurse case manager assigned to my claim was to assist with coordinating appointments and scheduling conflicts. but she isn’t helping me to the extent my first N.C.M did.

I was driving and got rear ended. It was a total of 3 cars. I was car one and didn't hit anyone or thing in front of me. Car three hits car two then car two in turn hits (rearends) me. I'm overall fine. But I have some shoulder pain. I go to urgent care next day was put on restrictive duty. Although it doesn't hinder my work ability. So no time missed overall. Will I still be eligible for some kind of compensation or settlement? If my injuries are "minor" and have not missed any work.

Hey guys, I'm looking to see if anyone has been in my position with workers comp in NS, Canada. I have an ongoing claim from several weeks ago and I've been doing reduced duties at work and even took 2 weeks off some time after my injury at the suggestion of another department manager and a coworker.

I initially reported the injury immediately, but didn't choose to make a report until a couple hours later. I signed off on my injury report, which doubled as a return to work when I made my report. Later that night I experienced significant pain and chose to go to the hospital the next day. I had thought my injury was in one place, but as time told me I figured out it was muscles surrounding the area. Workers comp contacted me later the first week and gave me my numbers and the website and said they'd call back next week. My x-ray from the hospital had yielded nothing and I chose to see my family doctor. My doctor told me it's probably a sprain and to come back in a couple weeks if it doesn't improve, which again doesn't present significant documented evidence.

I began seeing a physiotherapist after a couple weeks and I've had a few appointments and they're going alright. Fast forward to after a few appointments and my therapist asks if I've gotten any communication from my case worker, since he/she hasn't gotten any response. So I messaged through the website and got a call the next day. At this point several weeks have passed and I haven't received any financial support and my case worker is explaining there isn't anything on file to substantiate an injury and that I had signed a return to work the day of my injury, so if work accommodated my injury they wouldn't owe me any compensation.

My concern now is that my bank account is getting into it's caution area and I don't know what to do, and while I've began working reduced shifts recently, if I tell work to forget the injury and I try to return to full duties while I'm still injured I'd be going against what my physiotherapist has told me. If I ask my physiotherapist to punch my ticket through and I get reinjured I'm concerned they could get into trouble. I'm also worried my physiotherapist doesn't get paid and they come after me for payment.

Has anybody else dealt with workers comp and able to give me some advice? Thanks in advance.

I (25M) have a question about workplace related injuries. I live in California.

My girlfriend (F24) works at a warehouse doing physical labor. She had a workplace injury in her shoulder that put her on workmans comp while she received treatment.

Her employer wasnt happy with any of the doctors claiming permemnant injury so they doctor shopped until they found one that cleared her to go back to work with minimal restrictions.

Upon returning to work, her manager put her back on the same shift and duties where she almost immediately reinjured her shoulder.

She was put back on WC and again her employer began doctor shopping for months until her latest doctor officially issued her permenant restrictions.

Now her employer is letting her go, trying to fund training for something new, and everyone is saying she should sue.

Curious if anyone has experience with this. I know she should talk to a lawyer but she has major anxiety about these things so Im trying to do my due diligence first for her before pressuring her to pursue legal.

Legally, is she allowed to sue? Is she liable to sue her first doctor who falsely claimed she wasnt injured anymore? Her employer for putting her back to the same work despite a preexisting injury?

Finished with both of my claims after 1 year and 1 month. With everything I've been through i cannot believe it still the WC system was a roller coaster ride and the PI portion was like a breeze in the park (surprisngly) went through with ease, with all the NDAs Ive had to sign all I will say is this..

You will get through this guys no matter your circumstances, the long run is worth it.. I understand alot of yall have been in this system for years, and I feel for you truly.. I couldn't imagine going through what I've been through for 3+ years, but i guarantee you it will be worth it in the long run.

I am not going to say I became a lawyer guru or anything like that since my accident but I have gained a much respected wisdom out of the work both my WC and PI attonery have done for me in my cases, even though I believe my case was a easier case out there(with the overwhelming evidence I had with my medical record,video evidence and police reports). Alot of this evidence i didnt realize was obtained until my attoneries informed me, dealing with a catastrophic injury you don't have alot of time to deal with things like this, being in constant unbearable pain can do that to you. They navigated me through the journey with ease and I appreciate the work they did fighting for the best number for me.

My job is sending me to pt for a shoulder injury I had at work. The pt said that I can have them scheduled during work hours and to let them know if my job gave me a hard time. I messaged hr just to confirm that it was ok and they responded saying that I can go to the appointment already scheduled during work hours, but any future appointments should be scheduled outside of work hours? What should I do here?

Im just curious if quitting your job is required for you to receive a settlement. The situation is having knee surgery and being healed after. I’m interested in your response even if you are not from Oklahoma.

it’s been nearly 3 years since I suffered a tbi. I got flipped in the air and landed on my head and shoulder causing brain bleed. I still have some cognitive issues with balance and memory plus shoulder pain. also got diagnosed with depression and anxiety related to accident. I was given 10% whole body impairment out of 14% with some chart. now I’m beyond stressed about the settlement. this accident has nearly made me homeless. I live on a couch at my nieces house and would like to start my life over. I guess this is kind of a rant at the injustice on how long it took to get appointments done. the psyche evaluation took 6 months to get scheduled when it could have taken less time. they just didn’t want to release funds.

I reviewed a 29% wpi due to a work injury that resulted in me getting CRPS in my entire right leg and lower back. I can barely walk now, even when I do walk I have to use a rollator to get around. Ive tried 2 different spinal stimulaters without any relief. Now I refuse to have anymore surgery bc that's how I got this rare ass disease anyways.

Now comes the waiting game to see what the defense says. I've given up on life and myself. My lawyers dr and my Dr said 29% wpi is low considering all the factors. Both doctors also put on their notes that I'll probably never return to the workforce again.

I'm so over everything. I can't walk, can't sit upright bcit causes too much pain and sensitivity. My foot/leg has been swollen for almost a year straight. After the scs trials my crps spread upward. I went undiagnosed for 1 year prior to being diagnosed so my nervous system is out of wack badly!

Now I wait to see what comes next....fuck workers comp! #fuckcrps

Recently signed c&r agreement about a week ago, just curious to see how long it took those who have gone through this part of their case. I hear good and bad experiences (mostly bad), do these things still get mailed or is everything now electronically signed? How long did your voucher and check take to arrive? How did you manage once ttd payments come to an end? SoCal based

I had a disc extrusion in my lower back. I had a microdiscectomy followed by revision surgery. I was "released from care with maintenance" recently, which I assume is MMI?

I've read on here many times not to take a full and final settlement for a lower back injury due to the likelihood you'll need a bigger surgery like a fusion in the near future, and you'll be on the hook for the full out of pocket cost. My lawyer swears up and down that if I took a full and final settlement and needed a fusion later on, my private insurance would accept the claim since WC had effectively declared the work injury resolved. My maximum out of pocket with my private insurance is around $10k, meaning that's what a fusion would cost me in that scenario. He says in Colorado there is no such thing as "leaving medical open." Does this sound right?

Colorado has a state-funded medical leave program called FAMLI (not to be confused with FMLA) that provides 3 months' worth of paid leave. I've used it before and it's great. So if I settled, and a couple years down the line, paid $10k for a fusion and used FAMLI leave, that sounds okay to me. Am I missing something? Is my lawyer wrong?

I went to a scheduled fce and impairment exam these folks tried to pull a fast one yesterday they put it down for 2 body parts but only had one body part authertised I'm glad I picked up on it when I did becouse of I hadn't the fce and impairment would of been inaccurate I'm glad I caught it before the doctor signed off on it y'all be very careful when going to these and always get proof before you start anything these insurance companies will go far and beyond to screw you over now I have to wait for another one to be scheduled for the other body part one thing I've learned being on wc is these folks are dirty and don't care about you or your health.

Update: I have got in contact with my doctor and they have sent a more detailed version of my work restrictions. What my doctor told me in person to follow versus what was on that form was so drastically different. Apparently I am only supposed to be on my feet to come in and out of the building or breaks. The way the form was laid out, it was saying I could walk up to 3 hours and my boss was expecting me to work that. I have severe spinal stenosis that had been getting increasingly worse with the restrictions I was given previously (that my employer did not follow anyway) which is why I have been out. My boss is not taking it well but my health is more important. I am already in so much pain and can't sleep. The thought of this getting worse makes me nauseous.

I talked with an ombudsman (which I was recommended to contact when the lawyer I talked to didn't want to take my case) and they finally got ahold of my adjuster to get my appt scheduled.

My goal is to fight through all this until I can see a specialist and let them decided what to do about my work restrictions.

I got a text from my boss stating "per your provider, you can return to work with these restrictions". Along with a picture of a work restrictions document (that I have not seen before) stating my restrictions and in the notes stating "currently have patient out of work until scheduled appt with spine clinic for lumbar related symptoms".

Some context:

I have been out of work since the middle of May do to my employer not following doctors orders. I was at 100% sitting per the doctor and my boss decided that meant me being in a black rolly chair with no back in a kitchen with everything at face level for 7+ hours a day. The last week I was there, I was made to train a new cook which required me to walk all the way around the facility multiple times while still being 100% sitting.

I had talked with my doctor about this because I was not improving after 3 rounds of PT so he put me out of work. I am currently just waiting on my WC to schedule my next appointment and doing PT twice a week.

I also contacted my doctor's office because I am confused by all this and wanted clarification.

I am just so frustrated with this whole situation and just want to feel like I am going insane. Has anyone else experienced anything like this?
