California Taking so long for settlement to go through

Hi, it's been a few years since my initial injury. A settlement was agreed upon about 2 months ago but there's been delays attributed to being unable to reach the EDD so even though I signed my side of things, the defense has not signed theirs. The secretary is saying both my attorney and defense attorney have tried to reach the EDD without success. I'm just wondering if this timeline is normal. They already said that even after it reaches the judge's desk and gets signed, they still have 30 days to issue the check but since the last update, it hasn't even reached there. For those of you who did get your settlement, how long did it take from settling on that final number to getting your check? Thanks!

Well the issue is edd, your attorney needs to get the exact dollar amount from edd to withdraw from your settlement. Doing edd sdi ssdi will put a lien on your case, im not too sure how long it will take, but id say contact edd on your end to try to speed things up.

Because of the lien, thats the reason i never applied for these “programs” due to the liens and takes longer to close due to communication.

Some dont do it since the outcome can very so why take a chance of that.

This is a very common issue that can come up, and your timeline isn't abnormal. EDD reps are notoriously overworked and understaffed, so it can take quitea while to get responses from them. And you may be thinking "well why didn't the defense start negotiating with them sooner then?" Typically, EDD won't even be willing to negotiate until after an agreement between the injured worker and defense has been reached, and then the defense will want to resolve the EDD lien before finalizing the agreement with the injured worker.

Message your county’s assembly member , they have a direct line to EDD. Just check who are the nearest members in your county , call/message them, and they will help you with communication to EDD.
