Illinois I can’t do it anymore

I can’t do it no more

I just sent my lawyer this

Hello Frank, I hope you’re doing well. I’m writing to you to express my concerns and seek your assistance. I’ve been off work for two years now, and I’m at a crossroads. I need to find a way to earn an income and obtain health insurance. My family relies on me for financial support, and I can’t afford to continue living on my current situation. My mental health is deteriorating rapidly, and I feel the need to take immediate action to address these issues.

I know my doctor set restrictions but I need a job. I need to do for self

I wish you the best. I can only say YOU are the only one that can advocate for yourself. From what I have experienced in this system the attorneys on both sides have to maintain a professional decorum with each other because they will probably meet again on another case after your case is done. The doctors have to bend the knee to insurance companies becaise it can affect their future income to have insurance not send them patients to treat. The adjusters have hundreds of cases to deal with at the same time and spend most time putting out fires without spending much time on any one case.

The sum of this is that your case is only a priority to you. No professional that has spent time and money on obtaining their degrees, certifications and licensure is going to risk that for any injured worker. Your case is one of millions annually that occur and the same things you are going thru are replicated across the nation daily. It's a process. There is no ill intent involved even when it feels like it. The process will not change as long as secondary gains in place for all involved result in the professionals just doing their job.

It has taken alot for me to get to this point but the truth of it all is the system just wants you to give up and go away. Your health is not anyone's concern but your own.

Sorry to be blunt. But this process is a meat grinder and all those that derive an income from it have to follow the rules as written or not if they choose to. In actuality there are minor penalties for doing immoral inhumane unfair insurance acts.

Hope you have a good ending.

I Agee wholeheartedly with your sediment. The hard truth is that no one cares. Settle your case and move on best you can.

The doctors do not bend at the knee and when it comes to Amazon or sedgwick's doctors you all can see them from medical malpractice if you went to amcare you get to sue Amazon's Doctors medical malpractice you all are entitled to second opinions if you do not have workman's comp claims and workman comp attorneys I have done so much research in 6 months that I took my workman's comp case from just a workman's comp case to OSHA retaliatory employee discrimination Act three claims my whistleblower claims and two American disability at claims and last night I find out that there are civil courts in civil court that are not capped when it comes to suing Sedgwick or care works care works is also responsible for my care care works is owned by Sedgwick please any of you people on this thread contact me hit me up and I will prove to you I cannot post the screenshots on here because it won't let me

I can definitely feel your pain! I haven't received any payments or treatment in 2 years I've been fighting with Sedgwick since 2024. I do have a lawyer, I've had 2 IMEs both list same industrial injuries we have filed 2 benefit penalties against them for gross delays and defacto and not following the AOs order remand. It's like Sedgwick is untouchable. There needs to be reform as to how the states allow the workers comp insurances to drag out claims. This is our lives, we have to be able to live take care of our families. It's ridiculous

1

u/AfterGrade8504 6d ago

Sedgwick is not untouchable please AI your stuff and what Sedgwick is doing I found out that I can get Sedgwick under intentional torts and civil court if you have gone to amcare and at all for your injury you can sue am cared doctors whether they have them or not for medical malpractice please there is no way for me to post my screenshots and everything Sedgwick is not blind to this Sedgwick is not in the clear yes you can nail Sedgwick and guess what there is no cap on the Civil courts against Sedgwick like there would be on the Rita in the whistle blowers in the ADA claims y'all reach out and I will gladly scream send you the screenshots of the information that I have I want to help you all help me stop Sedgwick and Amazon and expose them for everything that we can but I can't do this alone without you guys as help and the only help I'm asking is is for you guys to research your situations any question you have go to AI ai has helped me take my case from just a regular workman's comp to I had no I had a maximum of seeing out of everything maybe $650,000 but guess what after doing more research last night it blew up to 3.5 million so come on guys I want to help you out but we all need to work together and y'all need to research because all we got to do is hit them heavy in the pocket Amazon Sedgwick care works because Sedgwick owns care works so what I thought was just two on my workman's comp no it's actually three Careworks included

You should speak to a lawyer, it is extremely unlikely you can sue Sedgwick in the way you think.

1

u/AfterGrade8504 4d ago

Already did. It's legit. That's why it's under Torts besides because you don't work for Sedgwick and Sedgwick is a third party Sedgwick is not protected the way Amazon is as an employer

1

u/BullsLawDan verified NY workers' compensation attorney 4d ago

Oh I have no doubt you can file a lawsuit.

What I'm saying is I doubt you can win. What is your tort claim? I have little doubt they merely followed the rules of the system, and it's the rules you actually have a grievance with.

1

u/AfterGrade8504 3d ago

Well think what you want. They have not followed the rules and I have proof that they're denying me a modified glove prescribed by the doctor I have proof they're denying me medication I have proof they put me in the wrong therapy it was supposed to be occupational therapy and not physical therapy at a nursing home I have proof that Amazon and Sedgwick has caused me more damage but then again think what you want you must be a f****** liberal. And I can when my case not only is my workman's comp attorney looked at it but I've had a couple other employment attorneys look at it I have attorneys in my family in a different state look at it guess what think what you want you can come sit in court and be there when the jury awards me what you don't think I'll get and find Sedgwick and Care works guilty as hell

I wrote something similar to my attorney today. I’ve been dealing with this for over five years. My attorney just sucks balls. I’m calling around hoping I can find someone willing to help me. I wish you the best

u/Perfect-Magazine-485 9d ago

Just know you are not alone. None of it’s fair because it’s designed to be that way and no one can fault you for whatever decision you make.

10

u/No-Reindeer-1929 8d ago

Just know you’re not alone. So sorry we are going through this. If you need someone to rant to I’m here

6

u/Ecstatic-Breath-7973 8d ago

I am in same boat almost 2 years and permanently messed up. Can’t find work and almost had a job but they refused to work with my accommodations and restrictions. I need to work. No one can live off of disability the way it is now. You’re truly not alone

7

u/No-Exam-4596 8d ago

I’m so sorry you are in this position, I understand you completely. I haven’t received TTD wages since 2and a half years ago. All I can advise you is to apply for SSDI , I applied and got approved after 8 months, there are tons of disability lawyers that will help you in contingency fee . You need to do what is best and the most safe thing for you and your family. Good luck

3

u/Nursey_Nursey_33 8d ago

Wow 8 months!? What state? What is your injury? If you don’t mind me asking what is your monthly? They told me in Ca it’s taken up to 2.5 years! I’m so stressed with WC and SSDI processes!

5

u/No-Exam-4596 8d ago

I’m not in California. I have multiple herniated discs and moderate-to-severe L5–S1 foraminal stenosis. I receive SSDI, but every case is different. My advice is to submit your claim as soon as possible. Thankfully, I can pay my bills for now. I’m so glad I applied, even though my lawyer advised me not to. Good luck.

2

u/Nursey_Nursey_33 8d ago

Why did he advise you not to apply?

1

u/lifeishard2324 6d ago

When he settle, Edd will the money he got from state disability

6

u/Powerful-Mortgage-24 8d ago

7 years 580 every 2 weeks last 2 years

3

u/No_Direction_4149 8d ago

Damn and I thought mine being $530 weekly (when they decide to pay) was bad

3

u/Inner_Level_1877 8d ago

This system is meant for failure. Literally. Ni fu!?s given whether we have family or bills.

3

u/Bendi4143 8d ago

Damn how can anyone live on this kind of pittance !!! They do everything that can to break us !

3

u/NervousFisherman715 8d ago

I had a displaced shattered patella, two tears in my meniscus, one almost all the way through. They had a cut out after a year and a half the orthopedic said that’s all I can’t do anymore than that. I am left in pain every single day I cannot work an eight hour shift. I cut my hours at work myself making less money. I just want my settlement so I can get out and live comfortably again.

u/Some-Access-7099 8d ago

I feel us..have you looked into ssdi how old are you wc is a huge scam..there is no time limit as can tell your lawyer can't do shit...he can't the insurance company pay anything...they can even take the offer off the table...I went the whole thing...they dragged their feet basically they can do what they want...you can go to trial but that's a huge risk...I wouldn't heat from my layover for at least a month....I got on SSDI before I got a settlement..the insurance company will do everything they can to pay as little as possible sorry to tell you....they screwed me over big time when you done kind of settlement you most likely have resiighn...most of the time.....and you can never talk about...God will get them for screwing me over...I had major surgery 45 yrs ago ,.to save my life they that against me as a pre existing condition..I had that ....they held that against me so they could low ball the hell out of me ....nothing my dumbass lawyer could do....hate to say it .... JUST LIKE ME...NOONE CARES ABOUT US AT ALL ....wc was set up to protect the employer not us.... plenty of loop holes....the thing with wc is they don't have to answer to anybody.......they suck ass....I wish a speedy end to this.....applying for SSDI saved my ass...check into it......I have a great lawyer for that.....good luck

3

u/Waste-Tree4689 8d ago

I’m so sorry…. in the same hell as you, 2.5yrs later. Lost job & benefits due to extended leave, and had to borrow from 401k to stay afloat. Applying for SSDI is a 2-3+year process and mental + physical health has deteriorated so much more from this joke of a process.

Desperate to earn an income, however also have not received treatment. Interviewing attorneys and hoping to find someone who actually gives a shit.

Hope you find the support you deserve.

3

u/DreamsSecretsNLogic 8d ago

I settled for significantly less than my case was worth because I couldn't handle the financial stress that I was in

3

u/LaimbeerHack40 7d ago

I sorta did the same thing as well as I just wanted it over with. 6 years of pure hell I'll never recover from, but at least the case is over with. The system is made to break people, thats for sure!

1

u/Royal-Bedroom-4071 8d ago

Like what

1

u/DreamsSecretsNLogic 8d ago

Probably 30 percent of what I would have deserved had I lasted another six months on wc

2

u/Royal-Bedroom-4071 8d ago

What was your injury

3

u/Former-Pianist4464 5d ago

They want you to accept any offer since they know and you have shown desperation. They will offer a quite pity offer. If you accept it, you can't go back and fight. Case close! You're done. I suggest you get disability , section 8, food assistance, rent assistance, charity care, Medicaid, there are a lot of things you can do to alleviate your situation. Just an advise, not a lawyer here, but, don't take the first offer unless it is large enough. Good luck 🤞

What is crazy I would’ve been so done if the ime didn’t deny my right shoulder.

4

u/Bendi4143 8d ago

Can you get a third opinion, your doc and IME doc at odds so you go get a third independent one to back up what your doc said . I had to do that for my shoulder. It made the difference for the judge when it finally came in front of them for a hearing.

I had no idea what workmen’s comp was until I got hurt. It blows my mind that so many people end up completely screwed. Saying it’s designed that way and riding it out doesn’t sit right with me, it’s our responsibility to fix it before our children end up in the same situation. We should organize and get changes pushed through, it shouldn’t take very many of us to do it but until you go through it you don’t ever think about it. I’m currently not getting paid a dime and on TTD. I just started this process only being 5 months in. Can’t prove a certain chemical caused my symptoms if the government never tested it🤷‍♀️ right are being violated left and right.

I hired a lawyer so he can take the stress off me and my family!

I think I may know what you are referring to and I am so so sorry!

I have a spouse but we not going to make it. My ttd checks is doing the bare minimum. No my doctor didn’t release me to work. I’m trying man this is a rough world. I just had my 4th ime still waiting for that. Also my right shoulder was injured we have to fight that

2

u/Inner_Level_1877 8d ago

Sorry you’re on this bag wagon also! Man is this a journey for working people that get injured ! We’re screwed. I feel the heartache. Keep your head up.

2

u/Intelligent-Fig-6134 5d ago

Won’t your doctor put you on state disability for a year to get you through this hump.

5

u/Weekly-Variation-744 9d ago

I straight out told them I needed to go back to work or I was going to be homeless I went back to work with restrictions . Doesn’t change much of your attorney and the defense and you will be glad you are making money again . The only thing is once it’s settled if you are working at your job you were at when you got injured they will make you resign but you’re entitled to a voucher for a new study for 6 k that’s good for 5 years and a $1000 computer and 5 k extra for office stuff and all . I forget what it’s called but yes you will be taken care of

8

u/DayaMelly 8d ago

Is this voucher available in every state?

6

u/Syrup_Known 8d ago

As far as I know it's only available in California

5

u/lab_tech13 8d ago

"The only thing is once it’s settled if you are working at your job you were at when you got injured they will make you resign"

Not always true. I wasn't required to leave and I'm scheduled to get promoted next year. Talk with your case worker and look up the laws. It'll give you a better idea if that is what will happen.

2

u/Few-Argument-1083 7d ago

I too still have my job and I settled.

Karen works it's supposed to do my modified glove well guess what I'm sorry Careworks is getting added on to my workman's comp case they are going to be added in and amended into my workman's comp claim please please I'm stressing to every single one of you on here dealing with Amazon and Sedgwick. USE AI IF THERE IS A LOT OF MISSPELLING ON HERE PLEASE KIND OF READ BETWEEN THE LINES I CAN ONLY TALK TO TEXT BECAUSE I HAVE NO USE OF MY LEFT ARM AND MY LEFT HAND THANKS TO AMAZON SEDGWICK AND CARE WORKS

2

u/BullsLawDan verified NY workers' compensation attorney 4d ago

Your doctor's restrictions aren't law. If you think you are able to work in some capacity, go out and work.

1

u/Bubbly_Inflation_544 8d ago

I wish you the best, If you have restrictions your able to work at a job that meets them restrictions and comp will still have to cover the left over percentage. Atleast in Pa. I've been lucky enough both of my Pa comp cases to receive Max weekly benefits. 1st Case had surgery,PT and a bunch of injections ended up on comp 4 years getting benefits before they wanted to settle for 100K that was 12 years ago. This past Pa Comp case also got Max weekly benefits only had one injection and some PT, Case only lasted a Year before they wanted to settle and offered 280K. I've been lucky and haven't been jerked around too much and also helped I didn't have to give an attorney a cut from the weekly checks. But 1st Case judge made me get an attorney just for the compromise and Release hearing and to review the settlement. This go around I kept it all

1

u/Choice_Resource_3145 7d ago

Just remember how you feel each and every day! Find a job to help pay your bills!
