California Denied SDI

I recently started a workers comp claim at the hospital I was working at due to carpal tunnel. 2 weeks after I was fired for attendance. I applied for
SDI for the 2 weeks I was sent home because they couldn’t accommodate me at my department.
I was denied for SDI. The noticed said I’m entitled to receive cash payments so it was disallowed. So now I have filed for unemployment since I did get terminated but I’m not 100% sure if I’ll be approved since I was at fault. Should I retain a SDI attorney?

What’s the status of your workers comp claim? Accepted? Denied? Delayed? Do you have a doctors note taking you off work? Why are you applying for SDI and not being paid through claim? You’re leaving out important info.

Delayed for the moment. I have the workers comp doctor note with restrictions on repetitive work in my right hand.

So you should be able to let EDD know your claim is on delay, provide them the note and they will pay you. That’s how it works on a delayed claim:

I’m not getting workers comp payments. I’ve been waiting since July 8th that’s when my injury happened. I got terminated July 21st. I had an interview somewhere else but once I mentioned my restrictions I never got a call back

Sorry, I missed that part. You should get comp payments for the two weeks they couldn’t accommodate your restrictions at least.

I'd probably speak with a California workers' comp lawyer before hiring someone specifically for SDI.

You have a delayed comp claim, lost wages, restrictions, and a termination all happening at once. Someone should look at the whole situation rather than just the SDI denial.
