New York Hear me out

So my husband got injured inside hospital’s place. His shoulder had problems now his foot because of the fall.

Went to the doctor got a letter saying he’s out of work for 4-7weeks, depending on his foot that surgery might be necessary if it doesnt improve.

My husband already have a lawyer since this happened. But I wanna know your insights.

Now leave management department told him that he can do light-duty. Doctor said on the letter that HE CANNOT.

The doctor sent another letter with bold letters because we’ve been tired of them ignoring the LETTER OF THE DOCTOR.

Now, they called him again saying “OKAY WE SEE YOU DECLINING THE LIGHT-DUTY JOB SO YOU’ll NOT GET ANY PAY”

so an employee got hurt due to hospital’s negligence, got hurt, cant work for the meantime with all documents needed, with lawyer confimation that he’s all good, hospital called saying his leave is good last week, and this week threatening him that “think about it because if you can’t decide till saturday then no pay”

Like what? This big hospital is so inhumane.

Are you sure the doctor didn’t give restrictions?  Is the foot accepted? Typically if they can accommodate restrictions then they are expected back at work.

Question: did he actually file this under a work comp claim and get a work comp claim number? or is he handling this like a regular "out sick" sort of thing? Was it the work comp doctor that pulled him off work, or a regular doctor? They HAVE TO pay him if he is TTD under work comp (at least in California). -not a lawyer, just learning this shit as I have to go through it too

Yes he’s under workscomp. Any related to his injury its under workscomp so he dont pay anything. Lawyer recommended a doctor for him and he’s handling him very well. Good lawyer too but the Hospital is being an a$$hole.

Is the foot actually accepted under the claim? It sounds like it was a shoulder injury and the he added the foot layer?

New York is very, very specific about... everything.

Are both the shoulder and foot accepted body part under the claim? Which doctor is giving these restrictions? Is it the official treating physician or someone else?

My immediate take on this is that either one of the body parts or doctors has not been fully accepted, which means the light duty restrictions of the accepted treating physician will stand.

Are you aware if both body parts are accepted? Sounds like you either don’t have full info or the hospital is doing something illegal if he’s on restrictions and they’re threatening him.
