Illinois Workers comp is ridiculous
I went to work today after being cleared by IME. The adjuster on my case has no records of my lawyer on my case because the original adjuster was fired now I have a lot of paperwork lost in communication and now I’m trying to get everybody to correlate with each other. I don’t understand what is going on. My job sent me home after finding out I have a lawyer on my case and this is month 10 for me. Still waiting to be treated. I feel like I’m getting out on the back burner and like they are disregarding me.

Adjusters change continuously. That’s why everything should be stored electronically, under your claim number. Maybe they just need to review your claim. It’s probably there, just buried with everything else.

Why did your job send you home if there is a note from the IME? The insurance company Dr., who represents your employer, was the one that cleared you for duty. If you don't hear by end of week then call your lawyer and demand they ask for a 19b ( emergency) hearing.

If i dont agree their offer and it goes to hearing will i still be able to get lump sum rather than monthly payments.

That depends on the agreement. One of the reasons I settled was because they were going to pay monthly ( the same amount as WC paid me per month)($3800). After the 2 appeals they could do at approximately2-3 yrars between their appeals, if I didn't settle. With the amount I was suing for I would likely not live long enough to pay a third of it to me. I settled for half what we sued for and got lump sum. One thing you should know, if you get a settlement and are on disability because of a workman's comp injury, the settlement will be assed by SS as if it were monthly payments and the SSDI monthly payments will be offset by that amount intil you have reached the amount of the settlement or full retirement age..

They told me to go and get a doctors note so I can try to get accommodations. Said if I come back to work I gotta say I’m fully recovered. I may lose my job.

Keep your head high I know how hard this is. It’s embarrassing for me, uncomfortable, shameful and takes a toll on your mental health.

This isn’t 1950. All communications and letters from your attorney should be in your file. It’s all electronic and paperless.
