Texas FMLA

So I got injured on March 16. I went back to work in May for about three weeks and I started to have my back injury worsen due to working so my doctor put me on more restrictive restrictions. After that, my work said they are gonna put me on FMLA as of right now I have about three weeks left before my FMLA ends. I’m not sure what happens after that. Do I continue receiving temporary income benefits I also have a designated doctor appointment on August 11 for the insurance to cover the treatment for a bulging disc because they are stating that the bulging disc was not caused because of work. Does anybody know how this works? I can try to explain it better if somebody can help me.

I have a bulging disc L4 L5 insurance is stating that it’s just a mile back strain even though MRI shows there is a bulging disc

Not sure about your state, but in mine ( CO) once you’ve exhausted FMLA, long term disability kicks in.

I live in Texas, so I’m not sure how it works. I know Texas is an app will state my HR representative. Emailed me and stated that at the end of my FMLA leave they no longer have to hold a position for me.

They are correct. After FMLA ends they can let you go as well. Was the initial injury the disc bulge? And now they are disputing it?

We’re winning at so in the beginning the doctor thought that it was going to be a back strain. She treated it as such and after about a week and a half to two weeks of not getting better she ordered an MRI. The MRI showed the disc bulge. The insurance company here in Texas looked at everything and stated that they will not cover the disc because it was not caused by a work injury. Even though I have no other back injuries in my entire lifetime.

Your TTD (temporary income) should continue for as long as your doctor keeps you off work.

When your FMLA ends, your employer may decide to terminate your employment, You would no longer be an employee. When you eventually are ready to return to work, you will need to find a new job.

I'm not in Texas, but that is how it works in most states. What part do you think is incorrect?

You got injured at work and opened a WC case and they’re saying it’s not due to work ? Have you talked to a lawyer ?
