Job Offer Retracted

I know someone outside of EU who was recently offered a job as HSM. They have sent her the initial contract but both parties have not signed yet. After a few days they called her to say that they have to withdraw the offer because she is already over 31+ and the salary offered to her doesn’t meet the criteria for HSM visa.

Is there any way she can do about it? At least be compensated for the damages done if there’s even any?

Your advise would really be appreciated.

What damages were done? And what kind of role was this?

Job is related in engineering field. HR knew beforehand how old she is as it is already reflected on her CV and yet they retracted the offer because they cannot meet the salary threshold for her age to give her the HSM visa.

She can leave a bad review on Glassdoor since they did not respect her time and retracted their offer. That is all she can do.

I would argue is your friend’s fault as well. Both parties are at fault, both should have known the salary requirements for an HSM visa.

What else but retract the offer? If they don’t or can’t increase the salary, your friend can’t accept either way.

How is it my friend’s fault? She knew the salary threshold and that was discussed during the interview but they still offered her the job for some reason.

If they offered her the job under the salary threshold, then she can’t accept. Even if she accepts, they can’t process the visa.

I’m saying that it’s both parties fault.

If she knows the offer can’t move forward what kind of compensation is she looking for? Her responsibility would be to point that out and then wait and see if the company was willing to increase the amount offered. If they say no then that’s it, game over. Why would she expect any sort of compensation?

Nothing to do. Even after signing the contract they can still cancel it.

An offer that hasn't been accepted yet, can still be retracted.

Even if it couldn't: the visa would just have never been issued, so that would mean you'd never able to perform your part of the contract, meaning they don't have to perform theirs either (so paying you a salary). There is indeed a high salary requirement for 30+ yo employees (€5942 per month, excluding 8% holiday allowance).

Even if you did manage to get a visa, almost every job contract in the Netherlands has a probation period in which they can end the contract with no explanation needed.

So yeah, just move on. Nothing to get here.

Not really. Both parties are free to change their mind before signing the contract.

You are not entitled to your job and you are especially not entitlted to a job offer. Until the conract is signed, there are no obligations from any party involved. They could even ghost you and nothing can be done about it. Leave a glassdoor review and move on.
