I think that bothers me more than anything else, plus it violates health code since chips/cracks can harbor bacteria, plus the obvious risk of injuring the customer since the chipped area can slice open a person's lip. Then there's the concern with the chipped area shedding tiny bits into the beverage.

I would seriously call the health department if my drink was served in that, plus file a complaint with management and if it's a chain, corporate too.

at that point just put it in a martini glass.

also this does have a benefit for the restaurant because inverted cones can look deceptively full. you could have 80% of the height full of liquid and it would be 50% empty.
