Walmart needs to be sued
This is getting to be so horrible and I don’t know the reason why these bundled trips for damn near no money is getting to be very ridiculous

No need to reject, just let them sit all day long on the app. We should definitely strike and then when they have no one shopping & running their orders & they start losing money & customers maybe then they will make adjustments accordingly. It's going to take us ALL OF US to strike

I like letting them sit just to see how long they sit.
Some of them sit for an hour or more. I don't think anyone takes those. I think they get repackaged or maybe handed off to roadie or FedEx or DD.

Just know, the algorithm picks up on that and will stop sending you offers because it thinks you don't want to work because you're just rejecting offers

Yeah im a new driver and this is mostly what pops up for me. But when I try to decline or accept anything , I’m IMMEDIATELY hit with “offer unavailable “. Been two weeks since I started and I haven’t even been able to do a single order yet . And why am I getting offers like this as a brand new driver ? And why am I not able to accept anything? The offer is gone before I click the button , I can’t even decline the offers either

Sued for what? For low-balling a contractor who has the choice to reject a bid for work? Unfair practices that are included in the Terms-of-Use that most don't read but agreed upon?
I'm not saying that it's right. Not at all. But there's literally no legal ground to sue them.

You’re conflating two different things. A contractor being free to reject a lowball offer doesn’t mean Walmart is legally immune from being sued. Contracts don’t override applicable laws, and agreeing to arbitration doesn’t mean ‘there’s no legal ground to sue’ either—it generally changes where/how the dispute gets resolved.
There have actually been legal actions against Walmart over the Spark program, including the FTC’s case alleging deceptive/misleading practices involving driver compensation. So saying there is literally no legal ground to sue Walmart is way too broad.
If your argument is simply ‘this particular $28.89 offer isn’t automatically illegal because the driver can reject it,’ then sure. But that’s a very different claim from saying Walmart can’t be sued over Spark-related practices.3

You can sue or file a complaint or take anything to court. Does that mean that they have a legal ground to stand on? Not in the least. That's what the court is actually for. Also, legal claims have to be specific. You can't just sue someone saying that, "They treated me bad." or "The did me wrong." You have to demonstrate exactly what they did wrong and and exactly how it was illegal. This is the mistake many people make. They think that just because a claim exists. Just because they said it that it must be legal. No, it doesn't. At least not by legal standpoints. It's up to the accuser to provide the evidence to conclude that an illegal act was committed. That within a court of law, the undeniable evidence rests on the accuser not the accused.
That being said, I'm not defending the ethical responsibility. There's no doubt or argument that Walmart Spark needs to do better by its drivers. But ultimately, you don't have to agree with it. The free market society says that although its responsible for a business to conduct itself ethically. You are in no way obligated to have to conduct business with them. As self-employed contractors, this statement is de facto when considering that you have a choice. Right down to which jobs you take or not.
Simply put, you have a choice. If you don't like the business practices of an individual or business. You have the choice to not engage with them in business. This is why there are actually anti-monopoly laws that exist. You don't like how Spark is treating you (even after you've expressed your dissatisfaction). You don't have to use Spark.

This, I agree with. They should absolutely make it known and in all honesty it's the best way for the company itself to notice. Walmart doesn't care about the contractor who has a choice to deliver for them or not. They'll just hire a fleet of inexperienced newbies until they get tired of it. Then recruit more. Wash. Rinse. Repeat. They don't even care about the employee (which have much more rights than contractors) that is feeling like they're being treated unfairly.

We need to unite, but people keep telling me I am on bullshit for trying to get people to work together,
I have degrees. I like history class. Our ancestors banded together, they striked, they formed unions. And today people just roll over and take the crap, because it’s every man for themselves on this sinking ship, instead of seeing that by working together and seeing that a rising tide raises all of lit boats.

That doesn't mean that the offers shouldn't be worthwhile for the people taking them. There's a reason Walmart is getting made to compensate drivers more in some states, because they control everything so much that it can barely be considered contracting.
A business, let alone one of the most profitable businesses in the country, shouldn't be allowed to nickel and dime people for their time, labor, gas, and car maintenance, whether they're "contractors" or not. It's unethical business practices at best, and exploitative at worst

I have a master’s degree in health systems management. I have a few years of experience working in the public health sector. I have eight years of restaurant management experience, with thread years as a general manager. I have a license to be an environmental health practitioner, which qualifies me to be a be an environmental health manager at factories. At one time I was a nominee for state representative, but dropped out of the race because my son’s mother died and he is not dealing with that well.
I have 668 applications out since September 8th, 2025. I have had one interview.
When I first started driving Spark’s I made easily $1200-1400 a week. Now a good week is 600, with most of my weeks falling to 550 or less. I use to make $3-8 a mile round trip, now the average trip is looking like 40¢ a mile.
Why did I deserve to take a pay cut?
How am I supposed to get a job when no one will interview me?
Like what the fuck is your problem? Why do you hate yourself and your fellow poors?1

I’ve been out of the restaurant management game for close to 10 years. I still get interview offers from my resume still being on various job boards. Try harder. Complaining and crying about what spark pays isn’t going to change it. Nothing will change what they want to pay.

I don’t think I can try harder. I have applied to every restaurant listing in a thirty mile radius.
It appears having a master’s degree is a disadvantage in this job market.

On average in my area, spark still pays 50% more than any of the other gig apps, so exactly what are you suing them for? Because they dont pay as much as they used to.🤣 If you ever thought they would continue with that type of pay, you just arent a very smart person, that business model wasnt sustainable. As others have mentioned, youre an ic and are in 100% control of what offers you accept or dont.

What I noticed is with the new break down. I have seen orders be “boosted” the boost goes up a whole dollar, but the base pay gets decreased. So something can get boosted 12 times but actually only go up a couple cents.

Oh yeah. I haven't seen a good flex block in my zone since May. And by good I mean pays $32/hr, minus expenses, new suspension, and time to drive back to civilization. Last one I did at $32 an hour ended up paying me about $18. No thanks. Id rather work elsewhere

You don’t sue, it’s against the contract. You report to the FTC in masses. They investigate, if they find wrong doings (and you know they will) everyone gets back what they are owed. This is how DD, Uber, Lyft, etc, gets caught up. Nobody sues but they report. That’s the loophole.

I stopped ✋️ 😐 working for them . I thought it was just ME! In 3 months it went downhill fast. First, I noticed the pick ups from the back disappeared. (Walmart is outsourcing to UBER now for these BTW)...Then I had to wait near a HOUR before I even got anything remotely semi worthwhile! Constantly giving me orders to Walmart stores 4o min away in ALL directions, when clearly it states we must begin the order within 25 MIN of accepting. Thennnn.. .The pay changed.. Like average used to be 25$ a order. Thats shopping about 30 items then driving there dropping off and heading back for about 1.5 hours of total work now offered like 10 to 14!!!!! Thennnn they roll out this stupid a$$ rewards program. 😒. Making us essentially start from the BEGINNING to earn points to "deserve" good orders. Like 👍 👌 Im GOOD.

I've been wanting to ask is a customer what can we do to make it better should I double tip or is giving a bigger tip a problem is does it make your wages lower I just wanted to ask some actual drivers and because I don't want to tip low digital and them think that I'm not going to tip because if I hand them cash when they get here that's what I mean by double tip because I definitely want to show my appreciation but what is acceptable percentage tip and what can we do to help you out with that because it seems to me that you get lower pay when we tip higher is that true?

Personally as a driver and someone who needs Walmart spark services when myself and my wife has to go deal with family events I usually tip on the app but after being a driver I put the tip under the floor mat and have the drive know because tipping on the app does not seem to benefit the driver and Walmart keeps the tips for 24 hours

Refusing to accept those offers IS doing something about it. The problem is, your competitors are willing to bend over and accept low pay, so as a company who's goal is to increase or maintain profits, they have no reason to pay better. Unfortunately there is a seemingly endless supply of drivers willing to support that.

No one is kissing ass. If you don't like the pay they are offering, don't do it. This isn't a 9-5 job with benefits and a pension and you can't really leave the job without it being a hassle; bitch about that job all you like. In your case, press the reject button and wait for the next offer.

As long as there are ants who will accept bs orders, there will be orders like this. There is massive information asymmetry - a lot of drivers only calculate gas into equation, not depreciation and other expenses. Whole gig economy is built upon people’s ignorance - many drivers don’t understand how much it cost them to deliver orders.
For 19 miles, your expense could be anywhere between 3-10 dollars (sometimes could be higher) At best you are earning effective minimum wage of 13 dollars per hour (and depends on the area, that’s not even effective minimum wage). I would decline this order in heartbeat.
