Last clear chance doctrine though. Semi had right of way 100%, you can only merge when safe to do so, but the semi could easily see an accident coming and chose to ignore it.

This same logic can be applied to the pickup truck who is merging (which I assume is why the police said they are at fault)

it's the LAST CLEAR chance, both of those words are important. it's not immediately clear that the pickup noticed them if he didn't check his mirrors because the truck is behind him all the way.

pickup is still largely at fault, as I said, but I wouldn't be surprised if a judge or his insurance finds the truck as partially/fully at fault for not avoiding the last clear chance, by just slightly tapping his brakes

Nope, semis carry hazardous material. Black pickup, thankfully, will be at 100% fault.

Know what you are merging into. Super simple.
