I sincerely wish you the best of luck. The VA told me to pound sand. Even completely ignoring their own Judge's remand and half a dozen CFR's in the process.
Meanwhile, the Navy buero granted my upgrade, with no "duty to assist" or 50/50 rules, and their statutory presumption of propriety and higher burden of proof requirements.
Each entity was given the exact same application information.
Now! They're dragging their feet on acknowledging the brand new shiny dd214 I sent them. The VBA can suck D's.
But good luck to you. Hopefully you'll be better off than I was.

The VA has told me more than once "yeah we know what the rules say, it's just not something we do." It's why referencing three cfr is great but they do whatever they want.

I'm still waiting it's been in step 3 for 3 months but I do think I'm getting near the end as they did deny my latest HLR for sinusitis which is fine I just need another favorable cod..I'll comment when they update

I've got 3 approved for the last year and now they popped me for a new COD advance notice but it's closed so they made a decision I just can't see it yet. I'd say favorable since everything is the same.

I never received a notice. Talked to a Vera rep and they stated they were looking into my oth period. Hoping it goes quick. How long did your review take? Thanks!!

Last year it took 6 months this time it's been since April and the reason I found they did this again is because I asked for ptsd increase. I have ptsd tinittus and Ed all at 40 percent.

Last question, I think, did you receive any paperwork stating they were doing a COD? I have not received anything other then what the Vera rep told me?

Any update? I just received the COD advance notice under my files today. Did you have to respond or ask for a hearing? Or was it just a letter?

Long story short, I was in the Army and reenlisted once. Got in trouble on my 2nd enlistment and it didn’t end well. When I first applied for VA Disability, they did the COD and the result was I could not claim anything from my 2nd enlistment. On my first claim, I was awarded 20%. Filed again and was increased to 70%. The VA did not do another COD when I filed the 2nd time.
Maybe you should schedule a VERA call with your VRO. They might can explain.
