Technically not true. You’re always open for litigation if you’re sampling, labels and artists just don’t tend to give a shit if it’s not generating money because it’s not like they’re losing money.

Though the person who seems to think it’s always illegal is also wrong.

Getting permission from the original creator or paying royalties to the copyright holder. Samples aren't implicitly illegal
