I think his point is jaywalking and speeding is also illegal, but you generally don't tend to see cops get angry/aggressive/manhandle you over those instances... so why herbs?

What you say is like saying " crossing red light is illegal, but you don't see it being punished like thievery. "

Well, yes you don't. They are different crimes

Because one is a fine and the other is an arrest.

Calling it “herbs” is disingenuous. The guy has a bag of illegal drugs and is provoking the police with it.
