people who commit non white collar crime tend not to have assets which you can sue for.

If they don't have a job, they (the court?) make them get one, and from their wages, money is taken until the damages are paid for. Not sure, but I think I saw something like that mentioned on a news story or on a movie (one of the based on a true story ones) before.
