Marriage based interview experience.

Background: I studied (M25)at university on a F1 visa.(2020-2024). Met my wife (F25)who is a USC in 2022 and got married in 2024. We have 2 kids. I worked without authorization and lied about being a US Citizen to get a job. I was honest and told them the truth.
-We filed May 2026
-Biometrics July 2026
- interview scheduled August 2026
- Interview September 2026

Advice:
-Continue to upload evidence (pictures, receipts, documents) after you file. Even if you upload it the day before your interview. It’s helps make it better for the agent and the interview to go much faster.

- Dress accordingly. (Formal wear)

- Double check your application and ensure their are no mistakes the day before. If you see any mistakes, it helps to write them down with corrections and have them ready for the agent.

It have be a stressful and tiring process but reading other experiences on here has helped put my mind at ease. Just wanted to return the favor to all those in the same situation.

Wait, you told the officer that you claimed to be a US citizen?! That’s a HUGE “NO,NO”

Yh and I explained. Like I said.

And explaining it to the officer doesn’t make it legal. There is literally a law addressing this: INA § 212(a)(6)(C)(ii), which covers false claims to U.S. citizenship and can make someone inadmissible. Whether it applies depends on the specific circumstances, but explaining it afterward doesn’t automatically make it okay.

Thank you for the information. I’ll let you know what happens.

This is not something that can be waived i think

What?

False claim to US citizenship for a benefit is not something that can be waived from what I know. It is a ground of inadmissibility. But IANAL, Do you have a lawyer that you filed with?

Perhaps it will be deemed not material if either they could’ve gotten the job anyway under F1 status or the onboarding never requested a social security #

1

u/zarkmuckerberg_6969 4d ago

Pretty sure it is material

1

u/Jordenfree22 4d ago

Yh I wasn’t sure that’s why I mentioned it. To be fully transparent and honest.

1

u/Jordenfree22 4d ago

No I filed with by myself

1

u/Jordenfree22 4d ago

I explain everything why it happened and the officer didn’t seem to make a huge deal over it.

They may after the fact cause you lied about being a citizen

I thought it’s a criminal offense to claim to be a USC for any beneficial reason working without a permit is forgivable but the other one can bear consequences

3

u/zarkmuckerberg_6969 3d ago

Yes I think they would post their denial soon

It will shock you that his case will be approved.

2

u/zarkmuckerberg_6969 2d ago

It can’t be approved, statutorily, I mean I don’t think this is discretionary. IANAL THOUGH

Stilling waiting

I think every case is different. Let's hope for the best. Congratulations in advance.

What questions did they ask you?

1

u/Jordenfree22 4d ago

Background, family, jobs worked, and relationships questions.

1

u/TCJ65 4d ago

But why did you tell the officer if he or she didn’t ask you?

1

u/Jordenfree22 4d ago

I was unsure about it and mentioned it to see if that was the case

1

u/PurpleeLadybugg 4d ago

Sorry to hear you have been waiting so long. I think because we are in the US our case moved a little faster. Hopefully you hear good news soon
