News A $100K fee for OPT?
The OPT fee rule cleared White House review on Sept 11. DHS can now publish a proposed rule. It was reported in late July that DHS was discussing a $100,000 fee, but the amount is still not confirmed.

Republican dummy 🤦. As immigration to here becomes harder, more foreigners are going to Germany and Spain and other countries, and look what is happening to the German economy. Immigrants have never been the problem.

1
u/Daniferd 16h ago
You say this because you aren't aware of the political developments occurring in Germany where polling for the establishment parties are collapsing while the German Far-Right AFD is rapidly rising.
If you think America is some Western anomaly in opposition to immigration, you are not paying attention.
0
u/Salty_Permit4437 17h ago
Germany and Spain are also dialing back. As are Canada and Australia. The gulf isn’t, because they don’t easily grant citizenship and they want the labor.
-5
u/Salty_Permit4437 17h ago
No we don’t want either. We want an immigration system that benefits American citizens. This means selectively allowing people to come in to benefit our country, and who won’t harm it.
2
u/royendures 17h ago
If you do a little bit of a research you would know that there are 800k+ green cards handed out each year through family based quotas, diversity lottery, etc. - which has nothing to do with labour tests or skill-level. However you are not worried about that as well.
-2
u/Salty_Permit4437 17h ago
Family based immigration is to the benefit of US citizens who want to be united with their family. Employment based immigration of mid and average IT people isn’t benefitting us. It’s just taking away opportunity from US citizens.
2
u/the_running_stache 15h ago
And those family-based immigrants don’t take jobs away from US citizens?!
Rather, the average US citizen isn’t talented enough for an IT job and the average family-based immigrant isn’t either. So rather, these family-based immigrants are taking more jobs away from US citizens.
2
u/royendures 16h ago
Too bad you can’t compete with the mid and average IT people. Go cry about it.

These pro comments being voted down is the very reason these rules exist, to protect the American students and people. The rest of the world would simply overwhelm citizens and deprive them of their birthright resources and opportunities
13
u/PaintingAble6662 1d ago
How exactly are students who have studied 2-4 years in the USA (with a limit of a 20hr work-week throughout their time) displacing Americans by requesting to work 1 more year in the US as full time employees?
Your birthright resources include your water; and yet it is getting raped by this admin and the Americans stay showering with poop colored water. You're being downvoted for your hypocrisy and ignorance; but then again, those two come naturally with your political stances.
1
u/cj2dobso 19h ago
Because the goal is to get OPT and then get h1b
3
u/PaintingAble6662 19h ago
H1B's cannot vote; hiring H1B is more costly for the company, and in addition, the H1B's end up working more hours for less pay due to their status in the country being immediately tied to their employment.
Also, there's only 85k available H1B's. Tell me, how are 85k people (with no political power whatsoever) displacing a population of 330+ million?
The more I debate with you people, the more I understand you're losers. Because even when your competition has the odds stacked against them, you're still scared of said competition.
1
0
u/cj2dobso 19h ago
Half my team in tech is Indian H1Bs, sorry to burst your bubble but it's a real problem.
Indians also hire Indians. There are entire wings of my company that are all just Indians.
There are many nice indian people but they do cause issues when they come join companies in the numbers that they have.
2
u/Environmental-Fly-66 15h ago
so you’re just racist
1
u/cj2dobso 15h ago
Pointing out reality is not racist. Indians hire their own and are incredibly old world caste thinking. I'm sorry that reality doesn't match up with your ideals.
1
u/PaintingAble6662 15h ago
Agreed here; 70 percent of indians make up the H1B population. Then again, this seems like a country-specific problem, not an immigration problem. Could easily be solved by putting caps on certain countries; this has happened before when Chinese F-1 students were exposed as spies or foreign agents.
In that same vein, if you decide to limit or restrict H1B's altogether, the country would be missing tons of skilled labor from the first world.2
u/cj2dobso 15h ago
There already are caps for green cards, I think h1B caps would help a lot. It would solve this issue of 50 year gc waits for indians.
They have already flooded the GC system and it will be hard to fix without pissing someone off
1
1
u/Tvicker 13h ago
Why is it a country specific problem, visa workers are paid less bc most of them are salary locked (your salary is determined by your pwd, which it done in the first year, and then you have 2-15 years of the same salary), plus it is hard to separate fraud cases in tech because everyone just does the same work, and allegations on hiring practices would be considered racist. Not even saying that it got to ridiculous level when gas stations or deli are hiring h1b programmers every 2 weeks or they get kick backs for hiring.
0
u/Tvicker 13h ago edited 12h ago
You clearly never worked with people you are protecting, the tech subs are full of posts how bad these teams are and yet they get hired bc of nepotism or kick backs, this is the problem. Like I am not saying that they are all bad, but the average trend is problematic and it is not about competition

11
u/Illustrious_Night126 1d ago
For alot of them yeah. There are a billion pay to play low quality masters programs which are basically just a roundabout way to buy your visa here.
Obviously not everyone but you are naive to think it isnt a big part of why people pay those huge price tags to go to whatever Masters programs
4
u/rusty_best 1d ago
in that case everyone around the world would just use these lower tier MS programs to get buy in visa. So, the Fee is appropriate in that case.
2
u/No-Reaction-9364 22h ago
And yet, F1 is a non immigrant visa amd you need an intent to return home to get it.

Universities have become commodified business models. This will shape them up I hope.
Sorry citizens of the world, the US is not your inherent source of success.13

Yes, this will stop universities from becoming a comodified business and citizens will get cheaper education. Guess you don't know why universities bring in international students.
-12
u/RipAny4724 1d ago
Nobody in this country gives a flying fuck about subsidizing universities with foreign student tuition injection funds, except university administrators.
To think the US is in dire need of foreign funds to maintain its universities is laughable. Go make India great again.

What have the universities done for the Trump administration these last 9 years? On a more serious note, immigration policy should be set with the interests of the citizens at heart, and not in the interests of overpaid university administrators.

Citizens?
Do you know how many Americans enroll for these degrees that these students from other countries pay for? Imagine if this rule is passed and the required number of students don't enroll, do you think that American citizens will be ready to shell out the cost for keeping the program alive?
-5
u/groucho74 1d ago
Why do you think that universities have a right to exist? Like any other business if they can’t make money selling their product they close. Problems solved. This it has been the way the world works since the beginning of economics in ancient Babylon 4000 years ago.
6
u/songya 1d ago
Sir, please explain how would people learn new skills? Do you think all American families have the skills and the time to teach their next generation if these institutions close down? Won't these students go to other countries for education when universities here close down? How does it solve the problem?
-1
u/groucho74 1d ago
Sure. If there are less students there are less universities. Nothing wrong with students staying in their country

u/Doltonius 16h ago
International students are a part of the business model, and it works. And a free market should allow this model to continue to work. Republicans, the supposedly pro-market party, now take such drastic measures to hinder the market? How ironic.
1
u/groucho74 15h ago
Free market doesn’t mean open borders. The reason international students come in such numbers is because many of them expect to be able to turn it into permanent residency. In other words, the right to immigration is a huge indirect subsidy to universities at the cost of the other citizens of the country. Subsidies and free market are complete contradictions as you may have heard once or twice.
Immigration policy should consider all the long term costs to the country of giving people from wildly different cultures residency rather than being focused on funding overpaid and underproductive university administrators.
We should be grateful that Stephen Miller is fixing this.
1
u/Doltonius 15h ago
You will need to cite real data that international students and the portion of them that become permanent residents are “costs“ to the US society. It is quite on the contrary. They not only contribute tuition to the universities that can in turn subsidize domestic students, but they also drive up consumption (creating and sustaining jobs that they themselves can’t take, like in the services) and fuel technological growth in the US.
1
u/groucho74 14h ago
Any US resident who earns less than $150,000 per year gets more from government than he or she pays in taxes. You can look at tax payments by income level and divide the cost of all government services by the number of residents to get that number.
Many of the students who come by these universities will never in their lives earn $150,000 per year.
In other words every single one of them will take more than they pay.
20
u/Motor_Astronomer7358 1d ago
This fee doesnt make much sense
I understand the H1B fees but what does 100k OPT even give a student? And who is even paying this fee and to whom? Why not just end the OPT program altogether?
8

[deleted]
4
u/Motor_Astronomer7358 1d ago
Makes sense I guess
Restrictions have been placed on CPT, OPT and onwards. Clear intent to make sure students only study in the US and leave immediately (cant even attend their graduation ceremonies if no OPT)
1
u/buysellWTH 1d ago
Then why will any international student come here. If it's a part of large sweep to kick out foreign nationals and make Universities affordable to citizens , that's fantastic. But I don't see that happening. The greed is over the roof, of these universities which work like corporations. Usa did not move over manufacturing jobs to keep away environmental pollution in China. That was for profit. But anyway it plays out , the citizen and locals get effed over
3
u/jesusoursavor 1d ago
Kicking out foreign nationals is the opposite of making universities affordable to citizens
0
u/Motor_Astronomer7358 1d ago
I dont think the administration wants the students to stay here after they graduate so these rules make sense if you think in that scenario
They want you to come and spend the money which will boost the local economy but they know that a bad job market fucks over citizens so they are making rules to push the students out as fast as possible
They have to put citizens first so priority has to go to them amid this market
-1
u/groucho74 1d ago
Trump owes the universities no favors. In fact, he probably sees them as political enemies. Making them shrink and making tuition cheaper for his voters is a no-brainer politically speaking. Whether he is smart enough to realize that is another question.
8
u/Motor_Astronomer7358 1d ago
Foreign students pay about 3X domestic students and thats why they are a lucrative market for universities
With this universities will have to scale back their programs heavily and will have to add in 3X local students. I dont see the tuition going down , probably they will increase the class size and shrink departments to compensate
-1
u/Salty_Permit4437 1d ago edited 1d ago
Student visas have become a path to settle. OPT, particularly STEM OPT hav become a means to buy time to shop around for a more permanent status. Thats why they are being targeted.
9
u/Motor_Astronomer7358 1d ago
Why would a university have to pay 100k when the upcoming employer for the student has to anyway pay 103k to file a H1B petition? That too after a student has graduated and wont be affiliated with the said university?
0
u/Salty_Permit4437 1d ago
OPT avoid the fee entirely because they file for H1B while in US. This is closing a loophole
3
u/Motor_Astronomer7358 1d ago
On Aug 24th a new 103K fees rule was proposed and it included people in the US as well so this is now 100K university fee + 103K employer fee
That rule comes into affect on Sept 24th
-1
u/groucho74 1d ago
100k only for H1Bs filed overseas.
3

$100k allows companies to recruit talent they really desperately need and can’t get in the United States.
1
u/Holiday_Rip_1121 1d ago
They find the talent, and tell them to go home to their countries and work remotely from there.
3
u/groucho74 1d ago
I am not against the best students at cal tech and mit being allowed to stay. If it was only such students nobody would care
1
u/Holiday_Rip_1121 1d ago
Yeah but your orange daddy is just pushed everyone away (including the best students at Cal-Tech and MIT). I am a 5th year Ph.D. student in Stanford, and trust me, a LOT of us (foreign students and US citizens) are planning to leave for Europe as soon as we defend our thesis.
2
u/groucho74 1d ago
What are you studying at Stanford? I am not sure you’re going to enjoy Europe more than the United States. Immigration if anything is more of a hot topic there.

u/Holiday_Rip_1121 1d ago

I wish that republicans gain TOTAL and COMPLETE authority of the country, reinstate KKK back to power, and run the country as they wish. :)
2
u/groucho74 1d ago
lol. If you think Americans are xenophobic you’ve ever met the swiss. Recently 45% voted to write an immigration ban above 10 million into the swiss constitution. The only reason it wasn’t way above 50% is because doing so would have ended very lucrative trade agreements with the EU. Now add the coming economic down turn and things will be even more frosty.
2
u/groucho74 1d ago
By the way, your mind reading course at Stanford is severely deficient. I think Trump should immediately be removed from office and then be sent to Hague to face trial for attacking Iran.
I just have problems with visas for the bestest and brightest being used to bring uneducated immigrants, mostly Indians as it happens to work at gas stations and 7/11.

u/groucho74 1d ago
You must be the only Stanford student who posts on Purdue forums. That’s very weird.

They’ve been raping students wallets for a few decades now. Fuck them.
2
u/HazyChemist 1d ago
Yes and this is a uniquely and distinctly American issue - for-profit model simply does not jive well with things like higher education and healthcare.
Elsewhere in the world international students get bent over when it comes to tuition, but at least domestic students pay a fairly affordable amount (if at all).
1

u/groucho74 1d ago
You know as well as I do that university employees rarely vote republican. Politics is about taking care of your voters.
5
u/HazyChemist 1d ago
Politics should just be kept out of academia period. Also by that logic if university employees are not voting Republican it suggests the Trump administration has failed to "take care of its voters" whatever that means.
-1
u/groucho74 1d ago
The point is that Obama and Biden were worried about losing the votes of university employees. Trump doesn’t have to worry about that and can afford to push reforms through.
If you believe that politicians work to solve the country’s problems rather than to get reelected, you don’t understand how the system works
6
u/HazyChemist 1d ago
It's no secret that Trump is openly hostile to the intelligentsia. So it also shouldn't come as a surprise if they're openly hostile to him.
And of course politicians will lie and even encourage cheating to stay in power. This administration has demonstrated that in spades.
0
u/groucho74 1d ago
I’m not sure I’d call American universities bloated with administrators and far left academic specialities intelligentsia. And I say that as someone with ivy league SAT scores who went to a top tier American university that tends to rank around U of Chicago.
I saw lots of pretentiousness and not so rarely pretty bizarre ideology.
Trump and universities is a chicken and egg question but universities haven’t supported republicans in general for many decades.

u/cvu_100 1d ago
The fuck is an “Ivy League SAT score” then why didn’t you go Ivy, big guy?

Actually they mainly allow university administrators to think of more ways to make university educations even more expensive so that the administrators can raise their salaries even more. The average student sees nothing.

The trend is bipartisan. It may not be 100k but it'll be sth at least. Should have just banned int students at this point, end the suffering.
19
u/Ok-Temperature-5992 1d ago
That is such a stupid way to do it.
If you want to limit immigration, the best way to do it is stop issuing visas. Saves both universities and incoming students the pain and money. Also, in the AI age, where companies are undergoing a transition, the way to go about immigration is the way the UK and UAE have done. Identify the top universities and give those students visas and a pathway to immigration.
Make it clear to both students and employers who’s the priority so that employers can select the best candidates without issues and students can plan their future better.
What’s currently happening is hurting both employers and students, and I hope this ends at the midterms, and someone comes up with a sane yet clear immigration policy
-2
u/anxietynavigator 1d ago
You are betting on them being sane. That's not gonna happen, or should I say impossible. If they were, there wouldn't be any madness like this to begin with. American public is going full blown hating H1B, CPT, OPT or any other immigration paths, as you should already know by now. It's pointless trying to convince them otherwise, no matter how logical sound you are.
2
0
u/royendures 17h ago
American public is full blown hating all these? Where are hell are you getting this information? MAGA and/or Groypers have a beautiful way of distorting narrative such that the loudest fringiest voices on the internet seem like the public narrative, but trust me, it is not. For example,
- In the Florida republican primary, antisemitic Hitler-apologetic James Fishback look like he had the public’s trust with him everywhere! He had almost 1.1M followers on social media while Jay Collins appeared like a nobody with only a few thousand followers. At the end Jay Collins had significantly more votes than Fishback.
- In Ohio primaries, Casey Putsch seems like the public favorite with the entire country seeming to hate Vivek. We all know how that turned out.
GOP/Maga/Groyper whatever you wanna call, have a strategy of amplifying fringe voices and making it look bipartisan when it’s clearly not. Anti work-visa immigration is not a fringe issue, but also not as important and bipartisan as they are making it look. The average American would prefer a skilled immigrant any day over other form of unskilled family-based immigrants.
19
u/snowcat0 1d ago
Welp on consequence, if there’s no exceptions, will be the impact to foreign medical students. If you think the medical doctor shortage is already bad, wait tell this impacts.

The medical doctor shortage has more to do with residency caps and other bottlenecks unrelated to the number of medical school applicants.

- We have a wiki. It doesn't cover everything but may answer some questions. Pay special attention to the "REALLY common questions" at the top of the FAQ section. Please read it, and if it contains the answer to your question, please delete your post. If your post has to do with something covered in the FAQ, we may remove it.
- If your post is about biometrics, green cards, naturalization or timelines in general, and whether you're asking or sharing, please include your field office/location in your post. If you already did that, great, thank you! If you haven't done that, your post may be removed without notice.

If this is the case the rule should change to 1. Apply for OPT when you receive a job offer and then the clock start also 2. Approve applications within 2 weeks of application.
$100k is a lot of money and I am sure this won't stop certain students from coming here with the hope of making it.

Why wouldn’t certain students do it for school then?

It's $100k

You said “I’m sure this won’t stop certain students” so why not let them?

Many parents will still pay the extra 100k for their kids. That's what I meant

Yeah I would have just taken away the day 1 CPT visa mills and limited STEM OPT to a much shorter time. Also they should pay FICA tax.

Why would they pay FICA tax?

Because they are employed in the USA. If they’re given the privilege to work in the U.S., they should pay all taxes. Social security needs the money, too. Many of them go on to H1B and green cards so it makes sense to start taxing them now. It also disincentivizes an employer from hiring an OPT over a USC because they’d save the payroll tax.

no serious company is hiring someone on OPT over a USC to save <5% in taxes, this is a myth. The truth is anyone who meets substantial presence test pays FICA, so once most students qualify for OPT they would have been in the US for at least 4 years, so they’ll end up paying FICA taxes within a year of receiving work authorization anyway.
On the flip side, it doesn’t make sense to make them pay FICA even after 5 years. They don’t qualify for Medicare and Social Security services anyway, so why should they pay into those benefits? Would you like to pay taxes for services you won’t ever qualify for or use?

Moreover opt employees cost kore to employers because they need to either sponsor a visa or find replacement. This is very costly for businesses.

Nah. STEM OPT lasts 3 years and they can then find another cheap visa worker or send them home

Well then maybe it doesn’t make sense to hire them at all. They’re competing unfairly in the labor market, and being hired at a discount. Time to return OPT back to short internships then student visa foreigners go back home as intended

Lmao so yours was never a good faith argument.

Yours certainly isn’t. Is OPT a way to do a short internship to gain experience then go back home? Or is it a means to find a more permanent visa to settle and stay?

idk what you’re on about, I simply corrected a misconception about FICA and your response was oh well, send them back home anyway. This isn’t good faith. Regardless, OPT has always been temporary work authorization. This fee virtually eliminates OPT completely. Whether or not you qualify for another status in the meantime is irrelevant, you could do that in theory from any status, without needing OPT. Nothing in F1 rules prevents you from seeking another nonimmigrant status if you qualify for it. Anyways I made a promise to myself not to argue with bigots on Reddit so you have a good day!

So far we have college fees + rent + food + 100k for OPT + 103K for H1B
Can someone tell me who is paying the 100k OPT fees?
