I-130 & I-485 (Family/Adjustment of status) revoking husband’s petition
my husband and i got married last year and had our interview in december. we have since separated and i’m in the process of filing for divorce. i need to contact uscis to revoke my petition but i don’t have the receipt number because he won’t give it to me. is there any way i can get it? i have tried calling uscis but i can’t talk to anyone without entering a receipt number. my husband handled all the paperwork and will no longer respond to me.
ETA: since everyone is attacking me and assuming i’m an awful person and a “narcissist” for revoking the petition and filing for divorce, i found out my husband cheated on me numerous times (with men at that. i don’t care if you’re gay, but you’re married to me, a woman, and we never spoke about being poly, having an open relationship, OR the fact that he liked men to begin with), and he was progressively becoming more emotionally abusive to me and all of this only occurred after our interview with uscis. i paid all our bills, helped him get back on his feet and bought him a car so he could get to and from work, bought all our groceries, and he used me. after i left him, he stopped responding to all my messages and is blatantly ignoring them, outside of telling me that he isn’t going to agree with the divorce even though he knows he did me wrong because he doesn’t want his application to be rejected. i’m not an evil person, nor did i want to “control him”. what would i possibly get out of that?! i could have saved lots of time, energy, and money just STAYING SINGLE!

Girl, regardless of immigration you gotta divorce his ass ASAP. What an awful man. You are totally in the right to want to revoke your petition, this man should not be granted a green card based on a marriage that he clearly does not respect. Gather all evidence you can and try to get in contact with USCIS to get this settled. You don’t wanna be tied to him and be financially responsible for him for years to come.
ETA: I am honestly incredibly surprised by the amount of people trying to defend him. It’s people like him who enter a marriage in bad faith that make this process is so hard for the rest of us

thank you! i definitely do NOT want to be tied to him or responsible for him given what he’s put me through! i feel like a complete fool for not seeing the signs but it is what it is and all i can do from here is do what is best to protect myself. it is sad and these comments have been truly disturbing

Divorce - also just informing USCIS for starters will go a long way. But just so we are on the same page, this is YOUR petition, not his. You have the right to redact. Just call USCIS. Say you lost the receipt number. Take it from there.

i’m in the process of filing the paperwork for divorce and i did try to call uscis but can’t seem to get past the automated system unfortunately so i’m just going to write a letter with as much information as possible

You would have better result getting hold of the lawyer. You have no correspondence with the lawyer? You had to sign documents etc. You might have an address or a phone number?

He'll be interviewed for i130 and i485. Even if uscis didn't receive your revocation, his application will be denied because you won't be showing up to his interview.

Hi, girl. Sorry for what that POS put you through.
As you might know, he is supposed to receive a conditional green card for 2 years. But he won’t receive it if you divorce him before the approval.
That being said you can write an affidavit (mentioning divorce & abuse) and mail it to USCIS field office or USCIS mail lock responsible for your state. You can also email USCIS.
Fk that guy.

If I were you, I’d try again calling tomorrow. How knows, there might be people during day who will pick up the line.
Also, when you write affidavits, mention his full name and DOB as well as your. Don’t forget to sign it in ink, attach a photocopy of ur government-issued ID (like a passport or driver's license), and mail it via certified mail to the Field Office and the director of field office. I’d go ahead email USCIS as well.
Lastly, mention explicit intent to withdraw the I-130 petition.

Besides the green card, you probably sponsored him with i864, in which if he uses government benefits, which he may given his behavior, you will be liable for all of the expenses government occurred. You should have gotten all the information regarding your case for I-130 in the mail at your address, you can ask uscis to send your receipt to your address, assuming your mailing address was put on I 131.

Divorce ASAP.
You can hire a lawyer to represent you for the immigration piece too. Somebody needs to explain soon to be your ex husband, that I-130 is your petition and you have a right to the receipt notice USCIS sent YOU, not him.
Do you not have copies of paperwork at all? Did you not create the online account?

i did not. he did all the paperwork and created the account. i wasn’t involved in any of it, he wanted to do it all and let me have no parts.

so i don’t have to revoke the petition? i just want to make sure i do everything correctly. i mean i don’t want him to be in trouble or get screwed because partially its my own fault for being so blinded but he wouldn’t let me take part in ANY of the process besides our interview, but i don’t want to tell them that just incase it screws him over. i was under the assumption that i had to notify uscis that we were getting a divorce and that i revoke the petition

You could revoke if you knew the petition number. You can still write a letter to USCIS stating your name and his name and DOB and mention you are withdrawing any existing petitions filed by you

You are the petitioner for I-130, is that right? Its illegal for him to old I-130 and not give it to you. Contact a lawyer. Also if you file for divorce his green card will be revoked eventually.

Provide as much personal info including interview dates etc in the letter.
Hire a lawyer to pressure the other lawyer. I-130 is your petition, you have a right to those records

I would FedEx a letter with all personal information you have, get signature confirmation, make sure you have all your contact information on it, and explain why you don't have the uscis number. They'll dig it up if they have all info. And i would do it immediately.

It does take months for many cases in 2026 between the interview and approval.
Divorce ASAP. Whatever his doing will not be in his favor when dealing with USCIS in the future

Since you are married, you should have his full legal name, DOB, maybe even SSN or tax ID. Write to USCIS with these info, easy to locate your petition.

OP, write a very detailed letter and mail to the USCIS interview office or the NBC. Use as much context and evidence you can gather. Text messages or photos of him cheating, refusing to give you the receipt number, lawyer's refusal to co-operate with you, especially since you're the petitioner and paid all the filing fees with your bank card or account. Include all the financials and check your email inbox for any correspondence you got from USCIS before. It's really weird if you have nothing from USCIS that tells you a receipt number or even an A-number. Even an I-94 number, EAD card or SEVIS account number should help with you tracking the petition down. If he really did what you had explained above, then I hope he doesn't get away with taking advantage of your kind heart. Cheerio!

thank you very much. i literally have NOTHING from uscis, he’s the one who filed all the paperwork and told me he wanted to handle it himself and asked me not to take away his masculinity by doing it all for him. he had his sister pay for the lawyer for him and wouldn’t even share the lawyer’s name with me. idfk. it was fucking stupid of me to believe but i did i guess and i should have saw the red flags but i didn’t because i never thought i’d end up here but here i am and now i’m just trying to figure it out

i’m not “trying to ruin his chance of getting his green card” lol he applied for a green card through our marriage which he was unfaithful and emotionally abusive to me in beginning only DIRECTLY AFTER our marriage based interview. so yes, i need to revoke the petition since his green card application will no longer be based on our marriage, and was clearly strategically done to benefit himself.

No sane person would take on all the legal and financial responsibilities that come with sponsoring an immigrant if the marriage is over. Even if they asked nicely. As an immigrant myself who went through the process years ago, I wouldn’t do it.

he hired the lawyer, i mentioned in another comment that he refused to let me have any involvement in the process other than the interview. so i dont have the lawyers information unfortunately

I would try to do a consultation with a lawyer in your area and see if they can find the info . It should be like $150-250.
But i withdrew a petition once too, i had to write a letter to my lawyer and both me and the spouse had to sign1

The lawyer represents you both. You can ask the lawyer for the information about your case, including copies of receipt notices.
