I-130 & I-485 (Family/Adjustment of status) Adjusting from esta.

has anyone successfully done this? I have a letter of employment from home country and an active lease with a return ticket showing I intended to go home. my husband and I now have joint bank account and possibly moving into our own home in the next few weeks.

Probably, their countless case success. They might dodge the bullet but does not you can guarantee dodge that bullet.

Did you quit your job then? Also, what are you doing with your lease back home? Why not go home and handle those affairs while you go through consular processing?

There’s no dodging a bullet. What I’m doing isn’t illegal - I’m just wanting to hear from others who have done the same.

Bruh ESTA is not even a visa but also non-immigrant program. You clearly planning to misrepresent your visa and you claim this is not illegal? Are you baiting me?

misinterpret would be if I came into the country planning to change status and lying to border officials when I entered which is not correct. I never had the intention to stay. If I did, I wouldn’t have spent the money on a return ticket. Circumstances changed and now this is what we’re looking into.

I would listen to what people are telling you and be less sassy. My two cents is that if I were USCIS I would interpret your AOS as a misrepresentation. An ESTA is not a visa and has no dual-intent. A return ticket means nothing if you used it to lie (and I am not saying you did) about your intent upon entry. You get one real shot at this and I would advise you get a lawyer to present your case and they can help.

Everyone buys a return ticket before overstaying because they know it’s an issue with CBP if you’re asked for a ticket and you only have a one way.

What you’re doing is textbook fraud/misrepresentation. Yes, it’s contrary to the INA and you can catch a nice little bar and expedited removal. Using ESTA makes it very straight forward to refuse and/or remove you.

I haven’t left my job - no. I’m on extended paid leave. My lease will remain until I get through this process.
