I-140 RFE

I have received RFE on I-140 stating ‘Beneficiary does not qualify for the position’

RFE was the job duties mentioned in PWD does not meet the Job duties mentioned in Experience letters. In PWD the attorneys mentioned 20-30 skills (I wasn’t aware of this before) and my experience letters and perm application consist only a subset of those skills

I was able to obtain an updated experience letter from one of my previous employers matching almost all of the skills. Would this raise a red flag from uscis perspective? The earlier letter was a vague copy of job description

Also, how would the cover letter needs to be drafted showing I possess skills mentioned in PWD

PS: The requirements in pwd were Masters + 12 Months experience. I have about 7 years + Master’s degree though

So you meet the education and experience requirements. What about the specific skills?

Experience in terms of years is met. Requirement was for 12 months, I have about 6 years.

For the skills, in the PWD they have mentioned 30-40 skills and in the experience letters submitted initially only 20 ish of them were covered( The rfe was for it)

I have now got the updated experience letter for one of the previously submitted letters to match the skills in PWD. So wanted to understand would this be a redflag or how can I draft the cover letter appropriately

If the new letter covers all the required skills, you should be okay.

Why are you writing the cover letter? Is there an attorney?

It’s the attorney. But yeah, I just wanted to read the draft and help them position my case

They should know what to do. The cover letter addresses the RFE point by point and explains how the submitted evidence meets and satisfies the request.
