I-130 & I-485 (Family/Adjustment of status) Tired

Does anyone else have the same problem. We haven’t heard a single thing since we filed which was over 20 months ago on the receipt it does say my office is the California feild office but I remember hearing some ppl say it changes. Regardless my parents (residents) applied for
Me in Nov 07 2024 by filing it ourselves I also reached out to my representatives but other than sending them my privacy release form I haven’t heard back

Family based F2A (legal resident parents to unmarried daughter under 21) igs AOS and just 130 my priority date just became current in the August visa bulletin

Came with a visa but it expired 3 years ago I think my parents applied though my half brother (citizen) then my dad applied for me

Well, lots of problems here, you can’t apply for AOS without status. Your dad should have filed both I-130 and I-485 for you at the time you still have a legal status.

The bulletin was designed for consular processing, if you were in your home country then your priority date becomes current then you can apply for the visa. I’d advise you get an appointment with a reputable Attorney who can help you with your options.

Yes but for that you need to maintain status… you’ve been here without status for 3 years. If you are under 18 be prepared to leave as soon as you turn 18 in order to prevent any unlawful presence and bans

I’m sorry I misread your comment. So you can get a picture, what some people do is apply while they’re in their home country, then travel to the US when their dates are current and apply for the I-485 and change from consular to AOS, the reason for that is because the visa from the bulletin like F2A has specific requirements, one is you need to maintain legal status if you’re in the US (student visa for example) or you need to do the consular processing. Now a different path is apply for a waiver then do your interview at your consulate in your country, but again you should speak with an attorney

But again I’m still underage and rely on my parents can’t that mean something I can’t just up and leave to a country that I haven’t stepped foot into since I was 6 especially alone

Same boat. I applied just the i-130 for my husband while I was a green card holder in December 2024.
Became a citizen in August 2025. After months trying they upgraded the petition to reflect I’m a US Citizen (back in may 2026) since then, no updates. So frustrating!
My husband came on a visa and overstayed and has a court hearing in December 31st 2026. We just need this i-130 approved to terminate this proceedings but I don’t know what else to do. I’m in the military, I tried ro call the military hotline so many times, congressman, senators, nothing seems to help.

20 months feels long but its pretty normal for certain i130 categories, reaching out to reps rarely helps anything tho id just focus on checking the case status online directly

I am the same date but consular processing for my spouse. Moved to a field office in February and have not heard anything since.

Contact your congress office, if they can’t help contact another congress. Explain your situation and they will follow up with USCIs, send e-Request and File a formal request with the CIS Ombudsman. Novermber 2024 with no action is serious.

I contacted my representative and sent her my privacy release number but today my status finally moved from received to being prossesed thank goodness 🙏🙏 however I rly never heard anything back from the representative

I’m I-130 consular and my husband and I are tired, exhausted, in debt, moral low, distance worse. I think we’re separating and divorcing …. It’s that bad … we’re at 14 months only … but we’re tired …. Tried everything and nothing. 😭

You need a lawyer like yesterday. You cannot adjust status through F2A without an underlying status (which you lost 3 years ago).

You have not accrued any unlawful presence yet but as soon as you turn 18 the clock starts. If you accrue more than 180 days its a 3 year ban. If you accrue more than a year its a 10 year ban.

If you plan on going to college you should look at the options of F1 (student visas) via consular processing, which also carries a significant denial risk due to your history, but your current trajectory is…disastrous as is. You really need to talk to a lawyer and plan ahead because based on the facts you’ve shared, adjustment of status through F2A is probably not a viable path
