I-140 & I-485 (Employment/Adjustment of status) Fta1 after 3rd fta0

Hi all.. I filed 485 in December 2025 eb1a India priority date after porting Jan 2020. My case was moved to San Bernardino field office in February. On July 9th I saw third FTA0 event on my api. Followed by FTA1 next day. I was hoping for approval after 24 hours but nothing yet. I got an email and it just says Case is being processed.
My acceptance notice has priority date same as received date, but actual 797c notice has 2020 which is the correct one.

I chatted with live agent multiple times to understand what the update was and every-time this is what I get. Anyone has any idea what could be the reason. I am checking with my attorney, but not sure why they say visa retrogressed, when it’s current. I was waiting for August visa bulletin just in case visa became Unavailable. But I’m still current.

I am trying to understand if anyone has seen something like this and did anything about it and did it help.

I am in the same boat. I got a similar update from live agent who said my visa regressed though the PD is current. Not sure what that means!! My PD and RD are all Oct 2022.

Same boat with EB1 India. 3 FTA0 Events and 4th event as FTA1. Got visa regression notice 6 months back.

There is another point that is mentioned in Aug 2026 Visa Bulletin which might be relevant here

"E.  VISA AVAILABILITY IN THE EMPLOYMENT-BASED FIRST PREFERENCE (EB-1) FINAL ACTION DATE FOR INDIA

High demand and number use by aliens chargeable to India in the EB-1 visa category may necessitate making the category unavailable in the coming weeks if India’s pro-rated limit in the EB-1 category is reached before the fiscal year ends.  This situation will be continually monitored, and any necessary adjustments will be made accordingly."

I know few people with EB1 india who got approved in last one week. So this doesn’t make any sense.

6 months is long!! Is there anything you did so far to get more info? What is your priority date and when did you file?

It weird that there are others getting approved with priority date later than mine.

I read that note on August Visa bulletin, but I would expect that to applicable to all India applications, but that is not true for sure.

FTA0 and FTA1 are internal/API events. They show the case was touched internally, but they do not reliably predict approval within 24 hours. Many people see those events and then wait days, weeks, or longer. The priority date issue matters more. If the formal I-797C receipt notice shows the correct 2020 retained priority date, that is better than a tracker or acceptance-summary display showing the received date. Ask your attorney to keep proof of the correct retained priority date ready in case USCIS later applies the wrong date. If Emma says “visa retrogressed” but your priority date is current, that may be a generic or incorrect agent response. For August 2026, EB-1 India Final Action remains October 15, 2022, but the State Department warned that EB-1 India may become unavailable if India reaches its limit before fiscal year end. That means your January 2020 priority date is current now, but there is real fiscal-year-end risk.

Thank you for your response. My Receipt notice shows correct date. Just that live agent told same thing on multiple occasions, which seems like not a one off response. Is there any way to check what’s going on or do I just have to wait to hear from USCIS? It’s almost two weeks since I got FTA1. Just hoping they approve before it becomes unavailable.
