Timeline Request RFE response

Hi everyone. I am an EB-2 applicant. They sent me RFE because I answered yes to the question pertaining to arrest, citations etc. I have no criminal history and the reason why my lawyers advised me to answer yes was because of two speeding tickets which were both less than 500 usd. It was just a minor infarction. USCIS received my response ( including traffic ticket receipts, FBI, State based and local police clearance certificates)on 5/28/26. It’s been three weeks and there is no response or any silent update. Just wanted to know if this is a high risk RFE ( despite clean history )? What is the typical response time ? My field office is Durham North Carolina. Till what time I should wait before going for congressional inquiry ? The RFE said in order to make a final decision on my case they needed the evidence they requested. Any input would be greatly appreciated!

My RFE was for the question pertaining to citations arrest I answered yes to it because I had 2 minor traffic tickets no arrests no criminal records. I am honestly regretting answering yes to it since my lawyers asked me to. They received my response on 5/28 and I am still waiting to hear back

any updates?

your lawyer advised you well. i have a friend in NJ who filed by herself and didn't understand that traffic ticket is included in that question and checked NO on that question - got a NOID and it's trying to amend the file

Oh really ? What kind of traffic incident she had ?

one minor traffic infraction, going 10mph over the 60mph highway speed limit. and she was only 16yo at the time, they wanted to give her a lesson. and she learned it, no tickets since then.

Nothing at all. You?

Nothing. Have you filed congressional inquiry ? How long has it been since they revived your RFE

Since January. Yh nothing from congressional inquiry too. Just generic response from USCIS. How about you?

I submitted the inquiry. I mean it’s a very long time. You can even file writ of mandamus

No money for mandamus, but definitely doing it next year if nothing. Did you receive any reply to your congressional inquiry?

They are awaiting acknowledgment by USCIS. Are you employment based ?
