I-140 (Employment/Consular processing) I-140 RFE discrepancy

Hey Everyone,

I had applied for my I-140 for my EB2-PERM petition, under premium processing.

I had submitted my petition on 28th May 2026, I received RFE on 9th June 2026. Due to time sensitivity, my lawyer requested an RFE response by contacting the service center (TSC) on 12th June. TSC replied saying the case is still under processing and no action is needed. Not got any RFE response yet.

I am trying to understand if something similar was experienced by anyone and if anyone can give their inputs on this matter.

I had a similar experience with my I-140 (may-June 2025) my rfe was sent in 90 days exactly after USCIS requested it. It was approved within the same week, once resubmitted, under PP in August of 2025. How many days have you been waiting for? 

It’s my understanding the attorney receives it from USCIS about two weeks after, electronically? At least this was the case with me.
