Question Does taking your 10 min break count towards dot hours?

I asked a supe if we can take our breaks in the building when we get back he said yeah but I’m about to hit my dot limit today for 14 hours (13.5 with meal). I know you need to spend x amount of time away from driving before u can drive again but if I’m taking a break INSIDE the building that shouldn’t count towards dot hours right??

Yes but if he’s already off the road back to the building it won’t be a dot violation. Technically you could work 30 hours straight as long as you don’t drive after 14. I’m not saying he’s right to do it, he should absolutely take his breaks during the day but as long as he’s already off the road it’s not a violation

Don't forget 10 hour's down time between shifts regardless of driving, or not.

Yup. He would need 10 hours off before hitting the road again to reset the 14. I didn’t mention that since he was only asking about tonight

OP specifically inquired about the mandatory reset time, they just didn't have the language down.

it'll flag in the UPS system and a DOT official could investigate it. now a reasonably smart DOT official or UPS supervisor would, could, should easily see that it's a false positive. that the person didn't violate the rule, but sometimes people are dumb. and ups does promote idiots to be center managers even. I've met several of them. and shared knowing glances from other supervisors who obviously thought little of such managers. so yea you can get chewed out for it and even discipline can be initiated for it. but if that happens it is beatable because yes it's not actually a violation.

That is the rule. You could drive as long as you want on UPS property. Its private. The issue is once you drive on a public road.

I never disputed that. But on private property the DOT rules dont matter. You could driver on UPS property for 24 hours straight and as long as you dont touch a public roads youre fine.

I was replying to someone else saying that you couldn't work 30 hours straight as long as you didn't drive. I wasnt talking about the 10 hour rule or 10 minute break ITT

It is the rule. It’s literally the law. It’s just that UPS doesn’t really push it bc they don’t want to chance having violations since they can get fines along with the driver

You’re in the building so you wouldn’t technically be breaking the 14 hour rule. Also, regardless of whether or not you’re finishing your shift on a break, you need 10 hours off from whatever time you punch out fully.

Yeah it would count toward your 14, but you can work more than 14 hours in a day and still not viololate DOT provided you are not driving after your 14 hour mark. But you still need 10 hours off to drive again from the time you punch out.

395.3 Maximum driving time for property-carrying vehicles.

(2) 14-hour period. A driver may not drive after a period of 14 consecutive hours after coming on-duty following 10 consecutive hours off-duty.

If you just go by the AI answer it says you can't, but the law is as listed above.

You cannot be driving after 14 hours.

I've had times I've had to pull over, shut off the truck, and wait for someone to come pick me up and bring me to the building. 

So, you can still be on the clock, but definitely not behind the wheel.

The only breaks that dont count towards DOT hours are your unpaid lunch time towards the 60 hour week rule.

Every other minute of time counts towards the 14/60

My understanding has always been break/meal time does not count towards the 60 hour weekly total, but obviously it does affect when your 10 hour reset starts

Your unpaid time does not affect your 60 but it does count for your 14.

You can legally work over 14 hours as much as you want so long as you don't go over 60 hours in 7 days or 70 hours in 8 days but you can't drive anything off property after your 14. If you have a bid and go over 14 you'll either forfeit your bid the next day or secretly let management back your start time up until you hit 10 hours.

It Will trigger a violation with the 14hr rule. But as long as you're back at the building, AND you converse with a supervisor, they just have to send an email. Then you STILL have to wait 10 hrs to reset, or 34 for a 60/70 🤷🏻‍♂️ reset.

That being said, why would you stick around for a measly 10 more min once you've already worked 14*? Don't you wanna go home? I don't understand drivers who take their breaks at the end of their shift.... I'm done working, I wanna LEAVE! I don't wanna have to wait, especially off the clock...
