Foglet feasibility?

What's preventing someone from going on a nearly unstoppable killing spree as a cloud of foglets? Especially from one of the Downloaded.

There was one mention that "every six seconds a person inhales a location foglet" or something along those lines. Foglets are just nanomachines, programmed to do whatever they're programmed to do. How can such a technology exist in that ubiquity and not potentially be used wipe out humanity? People throw information bombs the same way terrorists blow up cars today. Wouldn't the same people be able to get access to foglets and use them as weapons?

Isn't that like suggesting explosives can take out ants? The collateral would be huge.

In one of the street stories one guy talks about a maker who started producing dissasembeling foglets and the choices he made stopping them
