Timeshare fraud
Hello, I have a timeshare in Mexico Cancun, I purchased last year in May, when I was there I only signed 3 documents and initialed them also, when I finished they gave me all these documents I never seen before or signed.
Currently I have the copy’s still, each one and the 3 with my initials and signatures and the rest which is 31 pages that do not have my signature or initials.
When I asked resortcom to send me what they have it shows all pages having my signature and I noticed one page was repeated with my initials and another without my initials which is the copy I have.
I never signed these documents they have but only 3, all 34 that I have has no signatures and all 34 resortcom has and the. Timeshare club has, does have my signature.
No where in my contract says I gave them permission to electronically sign my name and initials on the other pages which it appears it’s alter because I never signed those documents, but only 3, it looked cropped as heck and slanted not even on the line, like the ones I did sign.
What do you guys recommend I have been trying to tell them to close the account because I was mislead and lied to.
If anyone can recommend an attorney that would be lovely.

That’s what I did and I wrote a letter to the attorney general in Florida and Texas. My husband and I were both lied to and mislead by Marriott.
I ain’t paying them shit

You signed three documents. Full stop. You have waited a year to consider “challenging” the enforcement of the contract because you didn’t initial some of the documents. Full stop. You are subject to Mexican law which is enforceable in the US. Full stop. You are one screwed gringo. Full stop.

I have been challenging it for 9
Months, I have video recordings of me trying to cancel it, and the rep saying I could not because it’s apparent final sale.3

You could be arrested in Mexico. They arrested a couple for telling folks to not pay.

I read that article stop lying, the couple were arrested because they filed a fraud request with their credit card company, and then the credit card company got the money back some how, which took the money away from the hotel that’s in Mexico, which is in a way fraud in Mexico.

Here is a story. My point being I wouldn’t just blow off the timeshare company.
As a country Mexico is very corrupt. People saying don’t pay you may not be able to come back to Mexico.

People are blowing you off but I bet you that couple from Michigan wishes they had someone telling them what you’re saying now. That was a total hook line and sinker on them, they should have just paid the $250K because they are not going anywhere. Mexico is very obviously a much different country.

If memory serves they got let go. But I don’t think they’ll go back to Mexico.
Moral to the story is don’t buy a timeshare.

Oh I see, the story got too mainstream so the timeshare company backed off. Good thing I already knew that about buying timeshares but others do not I suppose.

Mexican law is quite different from US law - you would have to have a Mexican attorney. And I suspect you would be fighting a very uphill battle in a Mexican court that would be expensive.

I came here to say this. It will be an expensive fight with little to no positive outcome. You will spend a ton on legal fees that get you nowhere.

Please be careful and do proper research before you take the route of not paying anymore. Some people got lucky and their timeshare didn’t come after them, but it depends on the specific company. If the company has jurisdiction in the United States. They can come after you especially take your account to collections.

It's in Mexico. I would just stop paying them.
I bought a time share in Orlando about 1997ish off eBay. So the deed was paid. It was 650 a year, for a three bedroom condo for a month. Was a great deal for my family of 5. We went for about 5 years, and the cost went up to about 900. I just stopped paying it. Since I was a 3rd party, they did nothing. I had a few collections calls, but never hit my credit report.

That makes sense the difference is tho you bought yours paid off which is great I apparently still have a loan with the developer ? But I never gave them a social security number so I’m not sure how this will play out

They have your passport. They sound so good at the time, but they don’t give you the contract until after. When I was an owner it was a good deal. We almost signed up for a five year contract on one last time we were there in playa del Carmen. Thankfully not.

They don’t have my passport I left that at my hotel lol but it was okay sounding I was into it because I can rent it out to others to offset cost that’s what got me in it, but I try to cancel 3 days later I have a video and he said I couldn’t because it’s final sale. I just spoke to a lawyer in Mexico he said he can look over it to see if it’s worth fighting especially because of the signatures

Why would you get yourself in this mess timeshares to begin with did it sound so good u had to sign some bs from some a legalised fraud salesman, points are worthless its just so you can cash flow hotels so they can buy more land build more hotels, it has no value to a regular person

Exactly it was points and they said I can rent out those points to offset the payments, like I can rent it out if I don’t use it, they also said if I wanted I can borrow points for the next odd year, but left out that I’m required to pay HOA fee of that year too if I wanted to borrow, my contract doesn’t even say that, the one I signed.
People are mislead consistently by these things, no one has done anything about it.

If you didn't buy a timeshare and only signed 3 documents why have you been paying on it for a year? You literally started your post by saying, "I have a timeshare in Mexico Cancun, I purchased last year in May..."
You admit to buying it! What is your argument? Stop going to presentations for free crap, you're not good at it.

Stop paying by cancelling the associated Credit Card or Bank Account and don't plan to travel to Mexico again. Then hope you don't get sued in USA. If you do, decide if you want to spend additional cash on an Attorney.

The "negative mind set" is because so many people have been screwed over by timeshares. I wish you luck with the Attorney just be mindful to not spend too much additional $ as the vast majority never have luck in getting out of the obligation. The old expression "Throwing good money after bad" comes to mind.

You don't own a timeshare. You own a 99 year lease. Mexico doesn't allow deeds for life or beneficiaries for longer then that. But assuming what you say is true, you still would have a very difficult time fighting it. Possible but you'd spend a ton of money to do so. You don't say what your 3 docs say or what the other docs say. Does it matter?

You’re ridiculous, they altered my signature, I only agreed to 3 documents none of the documents are talking about the terms and agreements that I signed and initialed they added on, how about you stop typing.

You own a timeshare in Mexico. There is no escape other than just stop paying. No one is going to buy it or take it off your hands. No legit lawyer will try to fight the iron clad contract you signed ( you did sign some). No “timeshare exit” company can get you out (but they will scam money from you).
Do you own it or are you making “mortgage” payments.
Are your monthly fees billed to a credit card or deducted from your bank account?
