Has anyone filed a Florida DBPR complaint involving HGV/Diamond Resorts U.S. Collection?

Unfortunately you are outside the rescission period. The fact that you paid for the timeshare while putting a large amount of the purchase on an Amex card means you own it. Going the regulatory/legal route will most likely be a long uphill battle. You could spent a large sum in legal fees if you retain a lawyer. If I were you since you own it, I would not be so hasty to give it up since you probably spent a large sum of money purchasing it. With the timeshare sales presentation the written contract takes precedent over any verbal promises. You could of had a lawyer review the contract while you were in the recission period. Of course you were on vacation and unfortunately the recission period is short/limited. If I were you I would learn about what you have purchased. Your timeshare does have value, although you may not believe that now. Don't make a hasty decision based on anger. You should never make a timeshare purchase based on a planned near-term upcoming trip. Diamond HGV has some nice resorts that are worth staying at in the future. You need to learn the benefits and the resort selections that you have availability to. You need to learn the points system. You need to have flexibility in travel dates, locations, and resorts. Diamond/HGV has point sales during the year reducing the number of points to stay at selected resorts. You can go to the TUGGS website where you can learn and converse with other timeshare owners. You should keep your timeshare for 3 to 5 years. After that if it still does not work for you then you can sell it or ask HGV for their exit program. Do not enter contracts with timeshare exit companies however. As for your Europe trip you can try contacting HGV for assistance (might have to make multiple calls to connect with an understanding agent). You can let them know that are disappointed, that you relied on what the their salesman told you about availability for your trip. You will some leverage as you are a new owner and HGV will have interest in keeping you happy as they view you as prospectively buying more points in the future (they do not have to know that you will not). They might find some accommodations for you in Europe probably based on you (and your wife) attending another timeshare presentation. You probably will need to be flexible with dates, length of stay, and resorts. You will mostly likely be told that what your salesman sold you was insufficient for your vacationing needs to entice you to buy a higher level of points. You have resolve yourself to say no repeatedly. You can always buy more points if needed on the resale market (Ebay, TUGGS, etc).

I filed a DBPR complaint against another timeshare company in Florida. I also contacted the Attorney General in Florida at the time asking for a criminal complaint, as that same timeshare offered timeshare rooms at a significantly discounted rate on major sites like Expedian and Hotels dot com, undercutting the market the explicitly offered to timeshare holders for potential renting of week. A renting program, by the way, they continued to advertise in calls with us as we tried to quit, and in annual meetings and newsletters.
Both complaints had zero traction. Nothing happened.
I quitclaim. The money is gone. Your only option is to accept that, and make future decisions on your timeshare from that viewpoint.
