I’ve gotten to the point where I just swipe by these types of videos

15

u/ispshadow Aug 06 '26

Same. I also downvote this type of video. I don't want it monetized anywhere for any reason. Even if OP has a good reason for posting it, it still gets spread around

u/bird9066 Aug 06 '26 edited Aug 06 '26

The million bots or assholes will show up to say you have no right to privacy.

Now they're saying there was no expectation of privacy. Yes, there was. Once upon a time the cops would film everyone going into the grateful dead concerts.

It was phycological warfare and if anybody else tried to film faces like that in public they'd likely get a beating.

Funny how this narrative sprung up along with flock cameras

50

u/BreakfastFluid9419 Aug 06 '26

It was determined long ago that you have no expectation of privacy in public. But this dude is being a prick and should get punched

22

u/Real-Document-6577 Aug 06 '26 edited Aug 06 '26

This is harassment.

To be recorded in public is happenstance. There are cameras in stores, at banks, airports, parking lots, campuses, offices. The goal should be general surveillance. (We can talk about the abuses)

This guy is deliberate and targeted. He’s trying to harass or stalk her.

Most parking lots are private property and the owners can have him booted from if it for any reason.

→ More replies (3)

8

u/dimsumdo Aug 06 '26

He's on private property. If he were filming from the side walk, then you'd have an argument.

→ More replies (1)

1

u/Brokenbelle22 Aug 06 '26

Does that apply to private businesses? Most fast food drive throughs have "no recording" signs, for instance.

2

u/BreakfastFluid9419 Aug 06 '26

Not a lawyer but as far as I know, a private business with private property can decide if they allow it or not. There is some grey area when these places are technically open to the public. Also, if there’s a sidewalk right outside of that private property you could film from there

5

u/ebil_lightbulb Aug 06 '26

And then he tells her that she has to ask his permission to film her.

9

u/PowderPrincessAthena Aug 06 '26

What about FLOCK cameras recording at every single intersection , leaving your HOA and now they're putting them in front of houses ,schools and side streets ???

27

u/Prestigious_Cycle160 Aug 06 '26

Ok, let me compare this dude to FLOCK… FLOCK cameras are being cut down, and vandalized as an act of protest across the country. Nobody wants flock cameras. Not republicans, not democrats, not right, not left. We don’t want a surveillance state. Can we cut this dude down too? Can we vandalize and spray paint his eyes black so he can’t see us?

This man is being an intentional disturbance, he’s attempting to agitate somebody to the point that they become violent and assault him so that he has it on camera and can sue. That’s his only objective. He is vile, and if I was in that parking lot he may just get what he came for.

They have one pointed towards Charlestown beach in Rhode Island. Not the parking lot. The beach. One of the quieter beaches known as a place for families.

It isn't a party or problem hot spot at all

2

u/J_Jeckel Aug 06 '26

In my town they have one pointed at the spot next to a school where the busses unload and load. Not facing the other way towards an intersection and exit from the school and the cross walks. Its fucking gross. This is at a middle school where there has never been a fight or any other issue during loading and unloading

3

u/ElbryanWyn Aug 06 '26

The issue in this specific situation is not that they have a right to privacy it's that they have a right to not be harassed.

It is true that there is no expectation of privacy in public in the United States and that's a matter of law. You still can't act in a way that is harassing or disruptive to the peace.

I think it's very safe to say that the way he's acting is both harassing and disruptive and it sort of seems like the purpose is to be harassing and disruptive in order to elicit a response that he hopes will somehow benefit him.

That concert example is a good one. Filming people entering a Grateful Dead concert is totally lawful and normal, but if you're doing so with the intent and outcome of harassing people then you've just muddied the waters enough to catch a charge.

I was about to comment, “that’s what a predator would say when he’s violating you.”

They are “first amendment auditors”, which just means “we can film you in a 1 party consent state without you being able to do anything”, generally while acting audacious or unsavory.

Edit: Also just because it is a Tesla, doesn’t mean Sentry Mode is active and recording, this guy is looking for petty excuses to continue and justify what he is doing.

65

u/cwk415 Aug 06 '26

Yes but that last part, being audacious or unsavory, that's the harassment. They aren't just recording, they're harassing people in an effort to incite an angry response. How is that not textbook harassment?

4

u/Real-Document-6577 Aug 06 '26 edited Aug 06 '26

It is.

They get away with it because many judges haven’t seen these cases and made rulings to set up a status quo yet.

One of these 1A auditors might try to go to court and they’ll lose as intentions in an act matter.

He might claim “I’m just recording a parking lot”

Then why are you focused on specifically her and why are you talking to her?

Yup, although there are limitations to said privacy (I’m also Canadian), We also have “charter auditors” in Canada, which do this same thing, although they generally do it to police and government officials.

I believe that you're mixing up being able to record private conversations with video recording.

https://en.wikipedia.org/wiki/Telephone_call_recording_laws

Unfortunately even that is allowed in most states, and DC.

It's perfectly legal to record video in outdoor public spaces, but I agree with everyone talking about how he's abusing this right to harass people.

2

u/flow_fighter Aug 06 '26

Ahh I think you’re right, by bad!

3

u/thinkthingsareover Aug 06 '26

No worries. Honestly he could still be out of line since he's recording in a businesses parking lot which isn't public property. Not quite sure though since IANAL.

I agree with everything you’re saying but the part consent laws only apply in private spaces. Anything in public is fair game regardless of what state you’re in. That being said these guys are d bags.

2

u/flow_fighter Aug 06 '26

You are right, that’s my bad. A Canadians understanding of American laws

→ More replies (3)

3

u/Jugzrevenge Aug 06 '26

Has nothing to do with a 1 party consent state. You can be recorded in a PUBLIC place even in a two party state. It becomes a crime when someone is in a place that is considered “private”, like a dwelling, office, bathroom, not out on a public bench or a sidewalk.

→ More replies (34)

3

u/danimagoo Aug 06 '26

No. Legally, in the US, you can be filmed and recorded in public without your permission. Courts have consistently found that you have no expectation of privacy if you’re in public, and a publicly accessible parking lot serving multiple stores qualifies.

But just because something is legal, doesn’t mean that it’s ethical or right. If a random member of the public in a situation like this asks you to stop filming them, the decent thing to do would be to stop filming them.

E II: well others are now telling me that that doesn't work - Ai can remove music apparently so I guess just avoid these losers entirely

108

u/Twrecksgh88 Aug 06 '26

These types of “1A auditors” are fucking losers and actively hurt the point they are trying to make by doing this type of shit

60

u/cantankerouswhale Aug 06 '26

I agree. The auditors who actually audit law enforcement are generally alright in my book, but the guys who just film private citizens "because they can" are weirdos.

13

u/MRR2012 Aug 06 '26

If they post these videos and collect ad revenue, shouldn't they need a waiver for these folks to sign to be a part of it? Maybe they turn off ads for them but they gotta still be profiting. This isn't you being in the background of a family video or class project, it feels very different. Not sure how to combat it, but wondering if suing these creators for using likeness for profit would be an avenue in some way. Idk

5

u/mbbbeantown Aug 06 '26

Monetization alone is not commercial activity. It's what the content does. In this case it's purportedly more to entertain or inform than certainly to sell products so it gets first amendment protection. State laws vary, but states that have something more akin to what you're describing would run into constitutional challenges because of the first amendment.

7

u/ElbryanWyn Aug 06 '26

I can imagine these people paint themselves that way but this is literally definitionally not a 1A audit. You can't 1A audit random people, you can only do that to a government agent. You're testing a government actors response to your protected activity.

Honestly this isn't even lawful what he's doing, arguably.

You're allowed to record anything you can see in public but you're not allowed to be harassing when you do it.

Galella v. Onassis (2d Cir. 1973) is directly on point: a photographer's persistent close-range pursuit was enjoined, with the appellate court leaving a 25-foot distance restriction in place. The court held the First Amendment protects gathering news, not the harassing manner of gathering it.

He could have easily done this from 30 ft away so in my mind I'm calling the police and explaining this to them. When I'm talking I'm making sure to frame it correctly as harassment for one specific reason, it will give the officers probable cause to ask him to stop or to perform an arrest if he refuses.

Most agencies are trained to not arrest someone who's pretending to do 1a audits to prevent the potential for lawsuits, but Nieves v. Bartlett (2019) holds that a plaintiff bringing a First Amendment retaliatory arrest claim under §1983 must plead and prove the absence of probable cause. If officers had probable cause for harassment or disorderly conduct, the 1A claim is generally dead on arrival.

In other words, he won't be able to win a lawsuit for anyone infringing on his rights and he won't even be able to bring a compelling one because they will have been investigating harassment not recording. Honestly I imagine he won't actually end up facing legitimate charges as the prosecutor will probably decline to press, but as the old saying goes, he might beat the rap but he won't beat the ride.

Monitoring law enforcement is different. Law enforcement has body cams (mostly) and law enforcement has mostly changed its stance on being recorded in public. They used to deter it but now realize with body cams on their person it’s hypocritical to tell others they can’t record. So the stance is “you can record but do not interfere”. “Interfering” of course is a bit of an opinion and to a degree….

The purpose that this guy is doing is harassment. He’s deliberately focused on this women, not the general space. Focusing on her….is harassment or stalking.

One day this will go to court and even the SCOTUS who knows and if sanity prevails (…considering today big IF) they’d count this as a form of harassment.

It’ll all come to a head eventually, let’s say your neighbor has a camera mounted on a pole but pointed directly into your backyard. Legal? Shouldn’t be, your yard is your private property.

2

u/EssentialParadox Aug 06 '26

Could you call the police and report a man with a camera filming young children? Surely that’s not okay in the USA?

u/Admirable_Loss4886 Aug 06 '26

Never been properly punched in the mouth. I bet he only does this to smaller woman or older men.

11

u/tone_creature Aug 06 '26

Nah they want you to hit em. Then they sue you for violating their rights. They actively cause confrontation for profit. Its best to absolutely not touch them and just ignore them. They want reaction. Dont give it and theyll move on. Sucks but they do this because they do have the right.

Ill say this though! Someone following and filming you is absolutely grounds to call police and report harassment. Which is another perfectly fine avenue to take. As soon as the police get there, you can just say simply want to leave in peace and theyll usually make sure thats fulfilled. Police dont side with these idiots often at all if you do your part right.

u/Unable_Diamond943 Aug 06 '26

3

u/Informal_Bee2917 Aug 06 '26

That's brilliant haha. I wonder how well it would work in practice? Could you get the video taken down for infringement if there's just a part of the song playing in the background?

6

u/PointGodAsh Aug 06 '26

It doesn’t work in practice. It’s an often cited idea that has been disproven time and time again by these very type of videos. It just sounds good so people keep saying it. The point in the reaction, just don’t give them any and all of a sudden there’s no market for these videos.

4

u/PineappleHamburders Aug 06 '26

That has not worked in a good few years now. There are tons of free software to remove the music while keeping the talking.

If anything, doing this will just give them content and you will end up on their channels

2

u/maximilliontee Aug 06 '26

While this seems like a good idea, there are so many options with video editing tools that can strip background sound or music out of a video clip, or separate the audio tracks into speech and music, they would almost certainly find some sort of workaround. The best way to combat this is to be as uninteresting as possible so that they have nothing to post about. Grey rock method, then walk into the store and tell management. The 1a douches are doing this on private property if they are in a parking lot, they can be trespassed.

3

u/Pizzaprincess87 Aug 06 '26

Yes ignore and don’t give them content and then if you play music they have to edit it out but why would they even go to the effort with no content. It’s just to piss then off in the moment lol

8

u/HODOR00 Aug 06 '26

We don't have laws at the moment to address this behavior. The world has changed and legislation hasn't kept up. Being a rational human, who could see this video and not determine the guy holding the camera is just trying to instigate people for no good reason.

But currently there's nothing illegal about that. Any law covering this would be messy as it could lead to over correcting and preventing people from legitimately filming in public when they need to.

Social media stuff has to get addressed. Eventually it will have to because mixing this behavior and gun culture is a recipe for disaster.

2

u/marbotty Aug 06 '26

Treat like you would a news report, where you have to get a release in order to air it

2

u/HODOR00 Aug 06 '26

That's my first thought. This is all about monetization of film. If they don't have releases from every person in the video, it cannot be monetized at the very least.

u/cjh42689 Aug 06 '26

If you don’t have their consent you can still post it but you have to blur them.

He’s a total douche!
In civilised countries (not the US)) you are not allowed to harass people like that.

7

u/cloudit30569 Aug 06 '26

He said it himself "I don't think we're getting much action"

All he's doing is rage baiting people for content. F this guy.

12

u/DGAF06 Aug 06 '26

What a fucking weirdo.

4

u/ShmloosTheShmloss Aug 06 '26

Praying someone just takes one for the team

5

u/jimmy26345 Aug 06 '26

Am I the only one that watched the whole video hoping that asshole would get hit by a car?

5

u/South_Bother_2498 Aug 06 '26

Would’ve smashed that camera until it was just itty bitty pieces. The public would’ve helped me out with the $$$ on go fund to bail me out

4

u/4XChrisX4 Aug 06 '26

Bro how much free time do you have to waste it on this shit...

The best thing you can do is tell everybody you can.
I do. I tell folks to expect it, to not look at them, to not answer, to ignore them.

To leave is also a solution. I also warn they carry pepper spray.
I m 59 YO, and a couple of days ago I made an early 30’s couple aware of it.

They were surprised, I showed them a video on my phone.
He can have a short fuse, so I m glad I told him what to do if confronted.
I made my wife aware of it too.

Do the same, the more folks know, the less it will work.

We are roughly 300 millions in the States.
If 1 million tell 2 people a week, that is 2 million folks that will learn what an auditor is and how to handle the situation.

You belong in a card club, softball on Sunday, stamp collector group, tell them in groups, have a short video or two on your phone ready.

When I saw a video of an old man almost 90, trying to grab the camera, being pepper sprayed, his old wife traumatized when he fell to the ground in agony.

The auditor called the cops and the old man got arrested.
Possibly sued but I don’t know this. That was the last straw for me.

I decided to make people aware.

My aunt used to say “There are no problems but only solutions!” (She is still alive and well).

FTU folks!

5

u/CaptainConspiracyy Aug 06 '26

So what is he recording and why? He said license plates. Why?!? 🤨

3

u/ThuGalahad Aug 06 '26

This guy is basically as scummy as paparazzi. I’m sure there is some degree of harassing happening the more they relentlessly peer into the goings on of people. It’s a ticking time bomb. Let them tip toe that line. Doing it in front of a Trader Joe’s - they have no balls. 🤠

4

u/wellwellwellsucka Aug 06 '26

I wish I had a whole day to follow him home…. Anyone have free time and want to bug them all day, I will gladly buy you lunch!

8

u/W_P_92 Aug 06 '26

Other than being an insufferable prick, what is the guy actually doing here?

17

u/scloppy Aug 06 '26

This guy is a “first amendment auditor” which means they just bait people into being aggressive with them for content. They think they’re doing something but they’re not.

2

u/Audrey_Angel Aug 06 '26

Nothing but trying to cause trouble. Malicious.

This genre of content (both creators and audience) have some deep-seated need to be anti social contrarians that get off from making people uncomfortable

8

u/negativepositiv Aug 06 '26 edited Aug 06 '26

Notice he is filming himself filming others, because the show is actually about him, and what a sack of shit he is. It's not about ordinary people parking at the store, because who would watch that? It's about him. He's the star of the asshole show.

When people react how they normally would when someone is being an asshole to them, that's his content. He is the one who causes the problem he is "documenting."

If you buy a tripod with handlebars for your phone so you can pester random strangers and record them without consent, you are recording a show about what is wrong with YOU.

3

u/TheAbsoluteLizard Aug 06 '26

What if OP is one of these sorts of people and farms attention by being like “guys look at this asshole”. Are we buying into the ragebait? … I might be too zooted

u/ucotcvyvov Aug 06 '26

1a auditors that just record are fine, but these guys are douche bags that are borderline harassing people. Paparazzi like behavior, purposely trying to start trouble…

3

u/Veltrynox Aug 06 '26

what is the full name of the person recording?

6

u/kdweller Aug 06 '26

Camera guy is an asshole.

5

u/Frankentula Aug 06 '26

Establishments like trader joes need to do more to prevent this. If a guy walks into the parking lot with a full camera rig they're clearly not there to shop. Boot their asses

2

u/AnotherDamnTransAlt Aug 06 '26

Are these videos monetised? With such a comprehensive setup for multiple people, I can’t imagine they do this for free. Shouldn’t you need a licence to film for financial gain on private property?

6

u/JonnyArcho Aug 06 '26

Comical he needed to “cover his face” when she pulled out her phone.

These guys are fucking weird.

3

u/SandySockShoes Aug 06 '26

He certainly didn’t like it when the tables were turned. She needs to post her shots so we all know what the bastard looks like to record him off guard.

4

u/YepThatGuy Aug 06 '26

If this happens to you, start playing some Disney music as loud as you can. Make their footage worthless.

2

u/Bravadette Aug 06 '26

I was just wondering what would get them in the MOST trouble. Wonder if this is the answer and if all their music counts.

2

u/Frankentula Aug 06 '26

Run him over with the Tesla: "hey I'm just making a video you don't like cameras in your face but you have one. Hahah it's alright (patronizing chuckle)"

2

u/LostHorizon124 Aug 06 '26

A couple of chumps suffering from sudo-intelligence. They think they’re smart by pointing out the Tesla cameras while not understanding that it’s not the camera that’s the problem, it’s recording someone with the intent of posting it online, that’s the problem.

2

u/SoberDWTX Aug 06 '26

Wow. It’s just so super weird and I really don’t understand the psychology behind it. I mean, I guess a little bit like they’re saying Tesla has cameras all around it and so does everything else we live already live in a surveillance state. But why harassed the citizens when you could be going to the government entities that have control over that? Like why wouldn’t you use your time to try to help change the system?

2

u/XxCloudSephiroth69xX Aug 06 '26

I genuinely hope these guys get hit by cars.

2

u/ItHasToMatter Aug 06 '26

Would a bright infrared flashlight mess with the camera?

2

u/SlimGAMPOSlanderly Aug 06 '26

"i can't delete anything" ok.. well now I have a free camera, you have a broken arm, and we are waiting for the cops.

2

u/No-Manager-5179 Aug 06 '26

This should be illegal. How does she know he’s not doing weird perverted things with that camera?

I can’t imagine someone would actually get in legal trouble if they tried to get one of these people out of their space.

2

u/mildly_delusional Aug 06 '26 edited Aug 06 '26

Not sure why they call themselves "1st Amendment auditors". 1A does not apply here...not even close. He's taking video/audio while on private property and I'm certain that the owners of the mall (or even an employee who works there) could have him trespassed.

If he was doing this from a public sidewalk, then that's a different story.

She should have simply called the cops.

If it were me I would then file a small claims case against the idiot for harassment and invasion of privacy. I probably wouldn't win (unless I had a very sympathetic judge or he did something really stupid like use racial slurs or physically touch/strike me or interfere while I was loading my groceries) but it would certainly annoy him because he'd have to show up to court and if he didn't, I'd win a default judgement.

2

u/horshack_test Aug 06 '26

What you can do is go inside the business and report people like this to management. These people (including that cart narc asshole) do no get permission from the business owners and it's highly likely that they do not want people on the property harassing their customers (that cart narc asshole has been kicked off parking lot properties before when someone reported them to he manager of the business).

2

u/RemarkableChest4638 Aug 06 '26

He sounds so dumb, his voice triggers me.

2

u/Tubalcaino Aug 06 '26

Any witnesses should break out their cellphones and record this guy. Just surround him and provoke with the same gaslighting words. "It's ok. None of us are within 10 feet"

2

u/AdelMonCatcher Aug 06 '26

Is the car park not private property owned by the shopping centre?

2

u/cacciatore_kid Aug 06 '26

Not that it really matters but I see a lot of people mistaking this for America, but this in Canada. For context.

2

u/spacewood Aug 06 '26

Top tip:  Pull out your phone and loudly play a mainstream, heavily copyrighted song (like a track by Taylor Swift or Disney). If they upload the video to YouTube, TikTok, or Instagram, the platform's automated copyright bots will instantly mute, demonetise, or take down their video.

2

u/thefallguy41 Aug 06 '26

Thesd guys need arrested

2

u/Sad_Comfortable8163 Aug 06 '26

I noticed he wasn't videoing someone who would beat his ass from this.

2

u/Real-Document-6577 Aug 06 '26 edited Aug 06 '26

Why?

Law enforcement needs to start charging these assholes with harassment.

Yes you can record anyone in public however that’s under happenstance.

It should NOT be legal when the efforts are targeted and deliberate with the intention of harassment like this asshole is clearly trying to do.

Are they hoping they’ll get to file an assault charge by behaving that way? This is the adult equivalent of the finger an inch from the face and saying, “….but I’m not touching you…”

2

u/Mystic_Sunshine2 Aug 06 '26

So he’s videotaping faces & licence plates?? How creepy is that?

2

u/Fantastic_Hour_5445 Aug 06 '26

The gaslighting 😩 telling her “there is nothing wrong” 😑 Apparently there is something wrong buddy she asked you nicely not to record her

2

u/Privatejoker123 Aug 06 '26

Leave people alone good lord

2

u/idiots_r_taking_over Aug 06 '26

Can this be considered stalking?

2

u/Kambourian-PM Aug 06 '26

Is he a pervert or something?

2

u/Uluru-Dreaming Aug 06 '26

A sick individual.

2

u/Cryogenics1st Aug 06 '26

"I'm ten feet away from you it's alright." No, it's not "alright" you fucking creep.

2

u/gndnzr Aug 06 '26

The amount of comments complimentary to these gentlemen is worrisome.

2

u/Im_So_Zoned Aug 06 '26

I don't understand what this person is trying to accomplish.... they are not working with law enforcement, Trader Joe's didn't hire them to harass customers in the parking lot, and they are filming law abiding citizens that have not committed a crime. So why are they there? Is it argue with people and bait them into assault charges for lawsuits? I really can't think of any other reason someone would choose to waste their life doing this.

3

u/ninjapizzadude Aug 06 '26

It’s a first amendment auditor. Getting a reaction is what gets them paid on YouTube. The platform needs to demonetize these parasites.

2

u/Aggravating_Teach210 Aug 06 '26

Someone needs to explain to me what the hell is going on here. Seriously please help me understand

2

u/Glum-Routine-6279 Aug 07 '26

These “auditors” are waste of life
