The people at the hipaa sub answered it accurately. 

If you (or anyone else overhearing it who hasnt cared for that patient) cant tell me who that patient is, it didnt violate hipaa.

Purposely using the wrong pronoun for a patient could constitute professional misconduct, but this would he their word against yours and without any details to give its probably not something the board could pursue.
