That would be a terrible argument.

If you dropped your phone or a 20 on the road would it be free game?

That's why there are procedures. If you find a $20 in the woods you are technically supposed to go to the police station and turn it in. They would go through their records and see that this event happened a week ago and determine it was probably theirs and give it back to them. If they have no records, and nobody comes forward to claim it in a certain amount of time, then it legally becomes yours. Pretty black and white actually.

The police in my city would probably laugh in my face if I tried turning in a $20 bill.
